There are two item that I am told we need to take up in executive session at this time. Then we'll come back to cdbg. The reason for this is that the county attorney says that based on the action that we take, they will know what to do in preparation for further discussion with us this afternoon.

>> we're going into executive session now?

>> yeah, but just for two item. Not for -- for item a-2, dhos approve agreement for legal services regarding lawsuit styled northwest Austin m.u.d. Number 1 is 11 verse alberto gonzales, attorney general of the united states, case number 106-cv-01384, plf, in the u.s. District court for the district of columbia, and the second one is one that joe gieselman says we need to take so we can give lcra some advice before a deadline, and that is number 17, which is to consider and take appropriate action on comments to the lower colorado river authority on the harbor ventures incorporated marina application, cross water yacht club in precinct 3.

>> that is related to number 29, so could you also announce that one?

>> a-2 was the only one that I announced. I announced a-2.

>> could you also announce number 29?

>> not if we're supposed to have a full discussion of it?

>> I don't think it will be.

>> a-2, we can do in a five minutes, can't we?

>> I think so. The reason we're doing this is to protect our right to go in there in case there's any overlap. Commissioner Daugherty wasn't in the meeting last week, so in case there's a question or two, this is a safeway legally. We plan to not cover the second one so much, be but then come back later in the day on just the second one.

>> 29, revised language, receive legal briefing and take appropriate action regarding case number 106-cv-o 1384 plf in the united states district court for the district of columbia, northwest Austin municipal utility district number one versus alberto gonzales, attorney general of the united states concerning preclearance politic act and constitution alty of Texas five of the voting rights act, 42 usc, section 1973-c. Both of these are under consultation with attorney exception to the open meetings act. The item regarding lcra is under consultation with attorney also. We'll discuss these three item and return to open court before taking any action.

Put those in final shape for the judge's signature. Asap and for submission to the lcra without the judge's signature if that will get it done.

We also discussed a 2, the matter involving retaining outside council to represent Travis County in the northwest Austin m.u.d. Number 1 versus alberto gonzalez to protect Travis County's interest. Based on the information that we received I move that we authorize the county attorney to -- to present a contract to renee hicks, along the line, same terms and condition that's we discussed and that were offered by mr. Hicks and that we -- that we request an update next Tuesday. October 31st on this matter. Discussion? All in favor? That passes by unanimous vote. So I think that takes care of item no. 29, also. We will have that back on next week.


that brings us to executive session today. A one is to receive briefing from county attorney on invoice received from wm investments number 6-10401 burnet road to the constable building. And this item may be considered in executive session pursuant to government code 551.071 consultation with attorney and also under the real property exemption to the open meetings act. We have previously discussed 21 today and don't need it again. We'll have it back on next week just in case we need a follow-up discussion with new legal counsel. That's October 31st. 30 is to receive briefing from county attorney and take appropriate action in Travis County, et al versus veh perry, consultation with attorney. 31, receive briefing from county attorney and take appropriate action in Travis County et al versus the hollow, incorporated. Duc nguyen resale deed. Consultation with attorney. 32, receive briefing from county attorney and take appropriate action in Travis County et al versus ww carron and associates inc., jiao resale deed, consultation with attorney. 33, receive briefing from county attorney and take appropriate action in Travis County et al versus bethly hem baptist church, del rioio resale deed. Consultation with attorney. Throarks receive fwreefg county attorney and take appropriate action in Travis County et al versus bethly hem baptist church. 35, receive briefing from county attorney and take appropriate action in Travis County versus the hollow, inc., nguyen retail deed. Consultation with attorney. 36, receive briefing from county attorney 'and take appropriate action in Travis County et al versus bethly hem baptist church, estrada resale deed. Consultation with attorney. 37, consider and take appropriate action on an offer to sell and/or lease Lake Travis area property to Travis County that is currently owned by barstow's limited partnership in presyringe three, consultation with attorney and real estate property exemption to the open meetings act. And the final item will be number 38, consider and take appropriate action on seller's temporary residential lease agreement with sandra mcelroy mirtsching rltd consultation with attorney and real property exemption to the open meetings act. We'll discuss those matters in executive session, but will return to open court before taking any action.


we have returned from executive session where we have discussed the following items. Number be 30, move that we sign the resale deed to always investments. Discussion? All in favor? That passes by unanimous vote. On number thrirt, move that we authorize the county judge to sign the prepared tax resale deed that covers four tracts of land, each of which has been prshd for 4 thousand $28,092.91, and the deed to duc nguyen.

>> win, I guess is how that's pronounced. Discussion? All in favor? That passes by unanimous vote. Number 31 was what we just covered. 32, move that we authorize the county judge to sign the prepared tax resale deed to check jiao, who has paid Travis County the sum of $4,100 in cash. Discussion? All in favor? That passes by unanimous vote. Number 33, move that we authorize the county judge to sign the prepared tax resale deed to fermin del rioio who has paid Travis County the sum of $7,100 in cash. Discussion discussion? All in favor? Is that passes by unanimous vote. Number, I proof that we -- number 34, I move that we sign the prepared tax resale deed to james patterson who has paid $1,921.18.

>> judge, is there two tracts?

>> yes. Each is for $1,921.18. Thank you very much. The same sum for each to james t. Patterson. Thank you. All in favor? That passes by unanimous vote. And the next one is another tax resale deed, and this one is for duc nguyen, and this is also for two tracts of land, and each of which is in what amount?

>> $4,915.70.

>> there it is on the deed. Each of them, two tracts. All in favor? That passes by unanimous vote. Next one, this is only for one tract of land, and only one amount of money. A tax resale deed to mario estrada, who has paid Travis County $1,921 in cash. Discussion? All in favor? That passes by unanimous vote. Number 37 is an offer to sell and/or lease Lake Travis area property to Travis County by barstow's limited partnership. We did give staff direction after a discussion. Any open court action? They will let us know when to put this matter back on the agenda for further discussion. 38, I move that we approve the proposed temporary residential lease agreement with sandra mcelroy mirtsching for two days. All in favor? That passes by unanimous vote. And our final item today, which we discussed, is item a-1, but no action is necessary today. That will be back on the court's agenda next week for discussion and appropriate action be. There being no further business...
