Executive Session Items

We've got 31, 32 and 34. Then I suggest we go into executive session, come back and take those items whether this more than or this afternoon. 38 is to receive briefing from county attorney and take appropriate action by j&j, et all, consultation with attorney. 39, receive briefing and/or consider settlement offer in raul meza versus Travis County, et all. Civil rights matter. Consultation with attorney matter. 40 is to receive briefing from county attorney and take appropriate action concerning contract with stanek associates, incorporated for research and recovery services. Consultation with attorney. 41, receive briefing and take appropriate action on a claim by the garfield water supply corporation for water supply to the county's southeast metropolitan park. Consultation with attorney. 42, receive legal briefing from county attorney and take appropriate action on general liability claim filed by ophelia malicia for water damage to her residence at 1405 canterbury, Austin, Texas, occurring on may 4, 2006. Consultation with attorney. 43, consider and take appropriate action on the potential purchase of real estate in central Austin. Consultation with attorney and real property exceptions to the open meetings act. 44, receive legal briefing on the proposed conservation development ordinance and take appropriate action. Consultation with attorney. 45, receive legal briefing on issues related to gasb 45. And for those listening, specifically don hilly and somebody in the auditor's office, glenn needs to know at vinson and elkins that we need him as soon as he can get here on item 45. And if there is a glitch, let us know. 46 is to consider and take appropriate action on medical examiner's office and executive manager oversight role. Consultation with attorney and personnel matters exceptions to the open meetings act. 47, consider and take appropriate action on the potential purchase of approximately 2.51 acres of land from sandra mirtscing in connection with the balance balcones canyonlands concentration plan, consultation with attorney and real estate exceptions to the open meetings act. Item number a-1 is receive legal advice from county attorney regarding chapter 26 hearing for the proposed change of use by the city of Austin for the cortana tract and take appropriate action. And this is the consultation with attorney exception to the open meetings act. Let's go back to one of the administrative operations items regarding the civil courts building. Number 34, let's noun it under consultation with attorney and the real estate exceptions to the open meetings act. 34, take appropriate action on scope of work for the new civil courts building. A lot depends on what the recommendation is there, what we consider basically whether it legally is justifiable. Will you let us know whether that's covered or not.

now this morning we did not reach two executive session items so we are get back to them right now. And a 1, receive advice from county attorney regarding chapter 26 hearing for the proposed change of use by the city of Austin for the c cortana track and take appropriate action. item number 38, the matter involving the j and j inc. Versus perez, mercer and others, move that we reject the offer to settle.

>> discussion? All in favor? That passes by unanimous vote. Number 39, the ra raul meza versus Travis County civil rights lawsuit. I move that we authorize the county attorney to counter the conditional offer to settle with the language that the Travis County county attorney's office has prepared.

>> that we had a chance to review. Discussion? All in favor. That passes by unanimous vote. Number 40, the matter involv involvings stanek associates incorporated. Move that we agree to settle the lawsuit, or the claim, for the sum of $16,600 in full settlement of this matter for all services provided to Travis County and terminate the agreement.

That passes by unanimous vote. 41 we did not discuss by john hillrd will keep working on that and at the appropriate time it will be brought to us if we need to take action. All right. Number 32 which involves the claim by ophelia malicia for water damage to her residence, this motion from the county attorney's office said that we authorize the county attorney to obtain a letter agreement from ophelia malicia outlining the county's commitment for rectifying damages to her home resulting from the water intrusion that occurred on may 4, 2006, and to authorize the expenditure of up to $85,000 for the remediation of the mold in her home. I should add to this that as soon as the same has been secured we should share that with the insurance company for the contract tor, put them on notice that we are spending money to resolve this issue and that the appropriate time we would expect them to pay the county in full. That's a two-part motion. Discussion? All in favor in that passes by unanimous vote. There is the first part in writing Commissioner Gomez probably wrote down my second part. 43, we did get advice from facilities on that potential purchase of real estate in central Austin. Any action?

>> passed unanimously. 44, the matter involving the conservation development ordinance. We did get legal advice on that one and got some questionsed answered. That will be on the court's agenda at the appropriate time in the future. Okay. 45, the same thing. Legal briefing. We appreciate vincent atkins for giving us that gasb 45. That will be back in the future also. 46, matter involving our testify manager who has had an oversight role in the medical examiner's office. Me that we extend 30 education with an additional 30 days unless we have hired an executive manager who will assume this oversight role of the medical examiner's office. Discussion? All in favor. That passes by unanimous vote. 47 involves 2.51 acres of land from sandra mirtsching. Commissioner dougherty.

>> yes. My motion would be to approve the purchase contract agreement and allow you, the judge, to sign the purchasing document.

>> okay.

>> second. And if I can clarify that the contract is in the amount of 450,000.

>> discussion? All in favor. That passes by unanimous vote. And on a 1, we did get legal advice on the cortana chapter hearing, chapter 26 hearing matter that is posted for public hearing and voting tomorrow at six o'clock here in the Commissioners court room. No action required tonight, though, right?
