Travis County Commissioners Court
September 26, 2006
Item 7
Number 7, consider and take appropriate action on request to adopt order setting the Travis County tax rate for the year beginning January 1, 2006.
>> this order is configured into three parts. The first part is the maintenance and operation tax rate, which is 3623. There happens to be a typo in a word that shouldn't be there in that particular section, the word purposes should be excluded where it says it has moved the property taxes purposes being increased, the word purposes is the remnant of a prior order, but substantively you have three separate motions. You have a motion for the m and o tax of 3623. You have a motion for the total debt service tax of .0876 and then have a third motion which is the addition of those two resulting in the tax rate of 4499, and a statement required by the new statute that articulates that this tax rate would decrease tax bes for m and o alone for a 100,000 home alone.
>> you are of the opinion that we need to be motions for those?
>> the law suggests that, and it says that the m and o needs to be worded in a lar way, which is the way of your particular part of the order. It is moved that the tax rate be increased is the wording that the statute requires.
>> next year let's just say yes, okay.
>> yes, sir. [ laughter ]
>> that is why I move that we set the maintenance and operations tax rate --
>> barbara said we had to read it exactly --
>> that the rate be increased.
>> she said yes, judge, and now you have to say I'll do it that way. [ laughter ]
>> yes, the law says that specifically. I didn't make that up.
>> be increased by and then the amount? By the adoption of a tax rate of .3623 for maintenance and operations.
>> you can stop there.
>> second.
>> well done.
>> it feels good to be in good legal hands, doesn't it, christian? Discussion? All in favor? That passes by unanimous vote. Somebody else do the second part.
>> I move that we levy for the --
>> it's only for maintenance and operations.
>> Commissioner, you can speak english.
>> move that the debt service equation that the debt service be .0876.
>> discussion? All in favor? That passes by unanimous vote.
>> do we have to say this wording here or not?
>> it's just the first one.
>> so we add those two together and we end up with a tax rate that voters want to hear about, and that is .4499 for each 100-dollar valuation. And taxpayers be mindful of your homestead exemption and the over65 for disabled.
>> second.
>> that was a summary. Now, this taxable rate will raise your taxes for maintenance and operations than last year's tax rate. The tax rate would decrease taxes for maintenance be and operation for a 100,000-dollar home by approximately $3.71. Is is that true? 100,000-dollar home or the average homestead?
>> no, 100,000-dollar home. The law requires in the motion -- in the order for you to declare what the tax impact would be on a 100,000-dollar home.
>> okay. So if your home is is twice the value of 100,000, then it would be a savings of $7.42. I have read that into the record as required by law. We don't need a motion for that, do we?
>> [inaudible - no mic].
>> is is thr more for this item?
>> we have three separate things we have to do, three motions.
>> we did the m and o, we did the debt service.
>> and then the last one would be to approve the order stating the total tax rate.
>> which I read a minute ago. Move approval of the total tax rate of .4499.
>> second.
>> all in favor? That passes by unanimous vote. [ laughter ]
>> clearry we didn't write -- clearry we didn't write the law.
>> too many legislatures in the lawyer I continue to say. [ laughter ]
>> all right.
