Number 3 is a public hearing to receive comments regarding a request to authorize the filing of an instrument to vacate a portion of a drainage easement located on lot 5, block a of decker creek estates section 4, a subdivision in precinct 1.

The property owner has asked for partial vacation of the easement in part because the house is constructed encroaching on the easement and that complicates any sale of property when that happens. The james sch li. Sher, a registered engineer, has looked and determined we will be able to vacate the easement without compromising the drainage pattern. With that certification, we would recommend the have I indication. But this is a public hearing to receive public comment regarding the proposed vacation.
>> mr. Sissler doesn't work for the county.
>> no, he does not, but he is a professional sealed, certified engineer and we would take his representation.
>> we will take his representation after our people in the know looked at it and agreed.
>> he is bound by his professional ethics to find out the facts and report them. Because he is a certified engineer, we believe that is sufficient for our purposes. We have relied on professional engineering judgments in the past for these types of things. Whether or not they work for the county or not.
>> would anyone like to give testimony during this public hearing? Let's put further discussion next year as a policy issue, mr. Geiselman.
