Number 2 is a public hearing to receive comments on a petition to create the Travis County bee cave gallon rein a road district number 1.

>> good morning, carol joseph with t.n.r. Last December we received an application to create a road district in Travis County to build a galleria parkway out in -- between 2222 and 71. During that process, as part of that process what we do is go through public hearing. We had the unified report. We had the financial report. We've done everything thus far and this is a public hearing to hear from anyone about the creation of the galleria. As part of that creation, we have a road operations -- district operations agreement which is part of what we have to do prior to actually creating the galleria. Here today is a public hearing. I would ask that you not approve the actual creation until we finalize the agreement. So far we have not come to a final agreement on the road operations agreement. Until we do that, I would ask that you defer action.

>> it would have helped me for it to come earlier, but we'll do that. I told people we have people here today just to answer questions. So the action item -- I know they are here, I told them to come down here. On number 29, you are saying don't take that up today?

>> not until we agree on the agreement.

>> you don't plan to have -- reach that agreement today, do you?

>> he's here and he may very well agree. [laughter]

>> your honor.

>> yes, sir.

>> reporter: Commissioners, david armbrust, we reached agreement a couple minutes ago so we're prepared to move forward.

>> do we need it in writing or --.

>> he just needs to sign the agreement and assuming --

>> we have a last-minute detail that just now got worked out, but it sounds like it's ready.

>> now, I guess we need to explain these road district he elections are kind of funny in that you have to reside in the district.

>> right.

>> or be a member of the district.

>> you have to reside.

>> to vote.

>> to vote.

>> and this is a commercial district that was raw land up until a few months ago.

>> one individual living in the district.

>> my point is there's one resident there now?

>> yes.

>> that the [inaudible] requires public hearing and the vote and the Commissioners court's position is that once the commercial development is operational, we will be able to determine the tax paying capacity and whether or not bonds should be issued for the road district at that point.

>> that's correct.

>> okay.

>> you all are the board and you can decide when the value, taxable value of the property is where you want to issue bonds at that point, that's when you issue the bonds.

>> okay. That being said, would anyone like to give testimony during this public hearing?

>> move the public hearing be closed.

>> second.

>> all in favor? That passes by unanimous vote. We will call up the action companion item 29 after the consent items.

>> okay.

>> so that should be fairly soon this morning.
