13 is to consider and take appropriate action regarding the following property and liability claim recommendations. The pharmacy item may take the a little time.

>> yeah.

>> may make all the sense in the world. Just that it's new and different. It's a dramatic change.

>> not really.

>> that the why it may take a little time.

>> we can come back.

>> sorry, I didn't realize what you all were here on.

>> okay.

>> actually, I think that--

>> it's not that difficult. We'll be happy to come back.

>> okay.

>> thank you.

>> we thank you.

>> we think better after lunch, really.

>> let's plan on like 1:45.

>> yes, sir.

>> okay. We'll try to squeeze you in there.

>> 13 is to consider and take appropriate action regarding the following property and liability claim recommendations. A, trñrn unit 21--tnr unit 2 2157, recommendation to settle. Any questions about this one one?

>> no. These folks get point on their driving record, right? They are departments that report to the Commissioners court.

>> that the correct.

>> okay. So some kind of--

>> that's correct.

>> okay. Some kind of action has been taken for improving driving skills, that kind of stuff.

>> that the true. The employee took a safety course, defensive driving, and did receive four points on the vehicle safety.

>> I move for approval of that one.

>> discussion? All in favor? That passes by unanimous vote. Show Commissioner Daugherty and send the rest of the morn. He had to run to another county matter > b is precinct 2 2661--unit 2661.

>> that was a con stabel attempting to change lanes and looked back over his shoulder and into his blind spot and turned back around and discovered traffic had stopped and he rear evened a vehicle in front of him. This is a claim to repair our vehicle and we're can go that 8,09.38 be transferred from the risk fund to fleet services to cover the repairs.

>> employee assess four vehicle safe points.

>> yes, the precinct does prescribe to vehicle safety policy so point were awarded.

>> do we have any department with drivers, employees driving to carry out their daily duties that do not use this approach?

>> .

>> yes, sir, there are several department that don't subscribe to the vehicle safety policy. The sheriff's office has their own policy.

>> as good as ours. We have approved it basically.

>> right.

>> okay.

>> move approval, judge.

>> second.

>> discussion? All in favor. That passes by unanimous vote. C is con stabel presick 2 unit 21--precinct 2135.

>> deputy rear-ended a third party and push the vehicle into another third party. Both of those claims have been settled. This is a claim to request transfer of funds to repair our vehicle in the amount of $28,406--2862.30. This employee did receive four vehicle safety points.

>> he no longer works for Travis County. Is that the same one.

>> that's the next one.

>> right.

>> all in favor. That passes than nousely. D is jess yliniemi.

>> third party. This driver failed to yeel the right-of-way coming out of a private drive and caused a collision. The county driver was cited for failure to yield right-of-way. The payment is for claimant, the property damage for the ant has been settle and this is for bodily injury claim that through a negative vat vated settlement is for 6500 6500. The original demand was 14,5 14,500 and we're recommending settlement in the 6500 amount.

>> this is the person no longer at tnr.

>> right, driver no longer employed.

>> discussion. All in favor? That passes by unanimous vote. And e is betty villasana.

>> betty villasana is a 63 63-year-old lady ho was walking on the sidewalk in front of the jail when she slipped and fell. She sustained injuries to the lower extremity and required surgery for broken leg and wrist and did incur some medical expense. However, in the investigation we have been unable to determine that Travis County was at fault in any way. The sidewalk was somewhat damp but it may have been due to the midst or drizzle. The sprinklers were not on at the time. The sidewalk was clear and clean. There was a small twig that was noted near where the third party fell. There's no indication that Travis County was liable. The sidewalk was in good repair. The maintenance crew was out working that day cleaning and sweeping. So we are recommending denial of the claim based on no liability.

>> did you have an opportunity to discuss it with her to explain where we were coming from?

>> she is represented and we have work through her attorney.

>> okay.

>> we have explained to the attorney and sent a letter to the attorney explaining this detail why we're recommending the denial.

>> okay. Move that we uphold the recommend ation of the risk manager to deny this claim.

>> second.

>> the recommendation for denial, of denial, is basically approved by the county attorney's office?

>> I believe so, yes.

>> discussion? All in favor, that passes by unanimous vote.

>> thank you.

>> move that we break until 1:30.

>> all in favor. That passes by unanimous vote also.
