I did announce 38 already. I don't think I need to reannounce it. 34 is is to receive brief rg from county attorney and take appropriate action concerning settlement offer in suit against jose escuadra to recover damages to a county owned guardrail. 35, receive fwreefg county attorney and take appropriate action regarding claim by michelle rayford floyd-janicke. 36, consider and take -- by the way, 35 is under consultation with attorney, as is 34. 36, consider and take appropriate action on the potential purchase of real estate in central Austin. Real estate exception. 37, discuss and take appropriate action regarding the purchase of the property at 10409 burnet road, precinct two office building. That's the real estate exception. 38 is the matter involving the city of Austin treatment plant number 4, which we announced previously. Consultation with attorney and real property exceptions. 39, receive legal vice and take appropriate action on pilot project for bear yat trick surgery for Travis County health plan enrollees. Consultation with attorney. 40, consider and take appropriate action regarding grievance panel decision regarding I don't carol bradshaw. Consultation with attorney and personnel matters exception to the open meetings act. 41, discuss applicants for Travis County health care district board of managers and take appropriate action. Personnel matters exception to the open meetings act. Just in case we need it. And there's another item that we discussed this morning --

>> number 12, the matter involving the metal detectors' use in Travis County parks. Thabl the consultation with attorney exception to the open meetings act. We'll discuss these matters in executive session, but will return to open court before taking any action.


we have return the from executive session where we discuss the following items.

>> we did get legal advice. We previously indicated we would have it back on the curt's agenda on September 19. Give us three weeks.

>> 19 or 12?

>> we decided we needed three weeks rather than two to get our research done.

>> not a problem.

>> okay. 34 invovving the claim, we accept the offer to settle this matter. For of $50 a month until-- until--payment of $50 a month until half the claim has been said. And we authorize the county judge to execute the settlement agreement prepared for us by the county attorney's office.

>> discussion? All in favor? That passes by unanimous vote. 35, move that we authorize Travis County representatives for the claim by michelle floyd- floyd-janicke.

>> we did discuss 36 involving the real estate in central Austin. Let's take another week to mull over this and have it back on next week for appropriate action action. 37, approval staff directions to proproceed to closing. Basically leave those directions in place. Anything else on that?

>> day after tomorrow, August 31 is closing dateokay. 38 involves the city of Austin proposal to amend the balcones canyon conservation land permit that involves the water treatment plant number 4, multi multipart motion, first of which is to indicate that in our view the legal and/or appropriate step to take is for us to have that chapter 26 public hearing, that it makes all the sense in the world for us to have ours after the city of Austin's public hearing, and we should give ourselves a week or two to really consider comments that we receive, that we direct a letter to the city of Austin indicating this decision, the need for the public hearing and the timing, and indicate to them when we think we can have this back on the court's agenda after the public hearing for deliberation by the Commissioner's court. Does that cover everything?

>> I think so. The other thing, judge, if at all possible, the city could try to us some kind of a drop-dead date that is not backwards in time. If we really need to get a sense of their deadlines other than two years ago zoke the reason I didn't put it--

>> okay. The reason I didn't put it that way, I assume they will respond to our within or two dates.

>> hopefully that is the case.

>> we will indicate what we think is appropriate. Perhaps they will respond to thatto offering at what they consider to be a better date.

>> there is a little problem though in that there are notice requirements for the public hearing. I think the most time consuming of which is an ad in the newspaper running three consecutive weeks. So if we get that in almost immediately, that really cuts into the time. So, but in that letter, and I have no problem with if these dates are not satisfactory, and you have earlier ones that you must meet, let us know. How is that?

>> well, while still allowing us to complete the chapter 26.

>> right. Is that okay?

>> sure.

>> should Commissioner Daugherty sign that letter.

>> somebody with some real power like county judge.

>> if I attached more questions, it will be a 1-page letter--14- letter--14-page letter.

>> that passes by unanimous vote vote. We did receive the legal advice regarding bearia trick surgery in item number 39. Let's mull over that and have it on the agenda at the appropriate time in the future. Number 40 involves the grievance panel decision in the jo carl bradshaw matter. We made an offer to settle last week. I move that we modify our offer to increase the amount to $4500, that the county judge be authorized to place that amount in the blank left by the county attorney's office in the prepared settlement agreement, and that if those terms are not satisfactory by five p.m. This coming Friday, and that the September--september 1, that the full amount be withdrawn and we revert back to supporting the panel decision in an amount of zero.

>> discussion? Basically we tip the monetary offer off the table on Friday at five p.m. All in favor. Two Commissioners, Davis, Gomez, dougherty voting in favor.

>> voting no.

>> voting know, Commissioner Sonleitner. We did discuss item number 41. I really want to thank all the applicants. The court should be advised now that I sent the other applicants that we had on shert list a letter.

>> we authorized that.

>> okay. I sent that out probably two weeks ago.

>> good.

>> I thought I was showing initiative all of a sudden. For the three that interviewed with you, certainly appreciate their interest in this public service opportunity and all of them were well qualified. Unfortunately though there's only one vacancy and I move that we appoint dr. Edwarda sanchez to fill the Travis County vacancy on the healthcare district board of managers.
