8. Reconsider and take appropriate action on date for a public hearing on the draft conservation development ordinance.

>> good morning, joe gieselman of the transportation natural resources department. A couple of sessions back, the Commissioners court actually adopted September 5th as the date for the public hearing. You have since received some correspondence from al kohrey, and t.n.r. Is doing some fiscal analysis of the ordinance. We will be coming to the court on August 29th with that analysis. I think at that time tom is prepared to give you a full legal briefing in executive session. On the legal aspects of the ordinance. Given that we are coming to the court with those two important features, we thought it probably wise to postpone the public hearing from September 5th to a later date. That could be as late as two weeks later or maybe three weeks later, but we thought rather than proceeding with the public hearing on the fifth, we would give the court a little bit more time to consider the fiscal impact, legal implications before going into a public hearing. I need to at least rescind the September 5th date and if we are not ready to post a new date for the public hearing, then just wait until the -- until the 29th to do that. Or go ahead and post a new public hearing date for later in September.

>> if we post -- did we post the other date?

>> no, we have not posted it.

>> move that we cancel the public hearing that we previously approved for --

>> second.

>> when was it approved.

>> for September 5th. All in favor? That passes by unanimous vote. What in your judgment is the best alternative date?

>> no less than two weeks later. That would take it to -- to -- excuse me. The 19th. Or the 26th.

>> what is your best judgment of an alternative date.

>> let's go with the 26th.

>> so moved.

>> let me ask a question.

>> yes, sir.

>> joe, have you talked to art to see when he really has the time to give --

>> I don't think he's going to put in any more time. I think we will be doing the fiscal analysis ourselves. We will run it by him to make sure that it reflects correctly what his -- he now has the correct version of the ordinance. We will have all of the data, run the analysis by both he and p.b.o. To make sure that they agree that the analysis is a correct analysis.

>> but we are just going to set the public hearing for September 26th.

>> right.

>> okay.

>> is there a second?

>> second.

>> discussion? All in favor? That passes by unanimous vote. Joe, several questions have come up in our discussion. Is your anticipation that we will have some sort of follow-up discussion with the court prior to the September 26th hearing?

>> on the 29th. August 29th we will have that discussion on the ordinance, yes.

>> okay. That would be on the -- a Tuesday, too?

>> yes.

>> okay. That would be good.
