Executive Session Items

Now according to my records we have reached executive session. I do have a couple or three legal questions regarding the metal detectors, it may be important for you to have that law with you. The antiquities and archaeological law, whatever it is. Because my question will go to it and include state jurisdiction versus county jurisdiction over county owned and/or managed parks. And the metal detectors item is, was that 25?

Now, number 37 we will call up at 3:00, we have others coming down, we have posted that at 3:00, legally we have to wait until 3 to call it up, we have enough other business to get to it before we get to it 37. Consider and take appropriate action regag grievance panel decision regarding a former transportation and natul resource employee, slot. 109. 1 and 3 personnel exceptions and attorney. That's the personnel matters exception to the open meetings act. 38. Consider and take appropriate action regag various personnel relatd matters with dr. David dolinak, chief medical examiner. Personnel matters. 39. Consider and take appropriate action on os from james ryan jones fr tax resale deeds in the following tax foreclosue sale properties:

Bob clark builders of Texas, inc. (h. Hune and ross richard-crow resale deed). 1 41. Receive briefing from the county attorney and take appropriate action in Travis County, et. Al. V. William t. Pledger, ii and delfina a. Pledger (maria g. Delgado resale deed). Consultation with attorney exception. 42. Receive briefing from the county attorney and take appropriate action in Travis County, et. Al. V. O.j. Wade, jr. And ann d. Wade (mount lago vista, llc not o.j. Simpson, o.j. Wade, jr. Consultation with attorney. 43. Receive briefing from the county attorney and take appropriate action in Travis County, et. Al. V. Robert f. Nelson (robert w. Ruggiero resale deed). 44. Receive briefing and take appropriate action in congressional redistricting litigation. Consultation with attorney. 45. Receive briefing and take appropriate action on settlement offer in fredrick pluet, (deceased) v. Margo frasier, et. Al. (pluet; frasier; civil rights) consultation with attorney exception to the open meetings act. 46. Receive legal briefing from county attorney and take appropriate action regarding: general liability claim filed by ophelia melicia for water damage to her residence at 1405 canterbury, Austin, Texas; and. Litigation against county contractor and insurance carrier. That's the consultation with attorney exception to the open meetings act. 47. Receive briefing from county attorney and take appropriate action regarding constable precinct 5 employee slot number 12. That's the consultation with attorney and the personnel matters exception to the open meetings act. And our final item in executive session today will be a 2. That is to consider and take appropriate action regarding resolution of contract issues with cc carlton industries, ltd, for work at east metro park phase 1, contract number 04 k 00363, consultation under the attorney exception to the open meetings act. We will discuss these matters in executive session and will return to open court before taking any action.


we have returned from executive session where we discussed the following items. Number 28 involving the metal detectors in Travis County parks. We did discuss that with legal counsel, and it will be back on the court's agenda on August 29th. In my view no action required today. Regarding number 37, the grievance hearing for the employee in slot number 109, I move that we postpone a hearing on this matter for two weeks until August 22nd. That we encourage county staff to meet with the exee's legal -- employee's legal representative to try to achieve a satisfactory settlement of this matter and that we authorize transportation and natural resources to post and fill this position.

>> yeah, judge, when it comes back, if it does come back within two weeks, we were scheduled to have a public hearing today. Will that number the format of a public hearing? Grievance hearing? I said grievance hearing, right.

>> hopefully it will be resolved by then, fwu not swrel the hearing that was resolved for today.

>> right.

>> okay.

>> I thought you had mr.

>> I wanted to say I would like to wait to hear -- before I make my decision for today.

>> and abstaining admissioner Davis.

>> we discussed 38 with our newly appointed chief medical examiner. In my view no action required today. Any disagreement with that? 39, move that we authorize the county judge to execute, to sign the prepared tax resale deed to james ryan jones. And this one deed covers several pieces of property. And it covers a, which involves a frakt of land that the county has received, 4 thu $320 in cash for. 39-b for which the county has received $4,600 in cash. 39-c for which the county has received $5,595 in cash. And 39-d for which the county has received $5,350 in cash.

>> discussion? All in favor? That passes by unanimous vote. Next is number 40, and I move that we authorize the county judge to sign the prepared tax resale deed to h. Hune and ross richard crow, who have paid Travis County the sum of $32,000.

>> discussion? All in favor? That passes by unanimous vote. And number '41, I move that we authorize the county judge to signed the prepared tax resale deed to maria g. Dell geed, who has paid Travis County the sum of $8,500.

>> discussion? All in favor? Number 42 I move that we authorize the county judge to sign the prepared tax resale deed mount lago vista, llc, which has paid Travis County the sum of $3,615.

>> discussion? All in favor? That passes by unanimous vote. And on number 43 I move that we authorize the county judge to sign the prepared tax resale deed to robert w. Ruggiero, who has paid Travis County the sum of $9,375 in cash.

>> any discussion? All in favor? That passes by unanimous vote. We discussed number 44 with legal counsel. I move that we authorize an additional five thousand dollars from the allocated reserve against which this legal representative should be building in the future for services and expenses.

>> judge, just a quick question. Does that get us there or do we have to have a contract modification in order to be able to complete that wish?

>> [ inaudible ].

>> I think they will have to bring back a contract.

>> okay.

>> 45 is a matter involving frederick pluet, deceased. We did get a briefing. In my view no action today. Anybody else?

>> I move that we reject the settlement offer and offer no counter at this point.

>> discussion? All in favor? That passes by unanimous vote. Number 46, the liability -- general liability claim failed by ophelia melicia, move that we authorize county staff to proceed with the necessary repairs and remediation to ms. Melicia's home, and b I move that we authorize the county attorney's if to initiate appropriate claims and litigation against the county contractor and insurance carrier.

>> second. And judge, on a we need to add that not to exceed 70,000.

>> not to exceed 70,000 in a, that's fine and friendly.

>> yeah.

>> any more discussion in all in favor? That passes by unanimous vote. 47, constable precinct 5 employee in slot number 12, move that we reject the counteroffer.

>> discussion? All in favor? That passes by unanimous vote. And in a-2, we did approve the terms of a settlement agreement, a specific one will be prepared and as long as it's consistent with the conditions, terms that we discussed, move that we authorize precinct 1 Commissioner Davis to execute settlement agreement.

>> discussion? All in favor? That passes by unanimous vote. Just a reminder that in addition to having tomorrow the budget hearings, we also have a public hearing tomorrow evening at 6:00 p.m. Otherwise we're done for business today.
