Executive Session Items

A-2 is an executive session item, right? It is to receive briefing from county attorney and take appropriate action, including designating deposition representatives in realty limited. That will be under the consultation with attorney to the open meetings act. And we have several other matters posted for executive session, beginning with item 32, consider and take appropriate action on medical examiner's office and executive manager oversight role. Consultation with attorney and personnel matters exceptions. To the open meetings act. 33, consider and take appropriate action regarding real estate contractual obligations on the precinct 3 office buildings property. That's the real estate exception. And we may as well list 33 under consultation with attorney. And on 32, did we say personnel matters plus legal? Okay. 34, receive briefing from county attorney and take appropriate action in naacp of Austin, nelson linder, sonya santana and david van os versus Texas secretary of state and Travis County clerk. That's the consultation with attorney exception to the open meetings act. 35, receive briefing from county attorney and take appropriate action regarding settlement offer in elizabeth hernandez case. It's a subrogation matter. That's the consultation with attorney exception to the open meetings act.

>> 36, receive briefing from county attorney and take appropriate action regarding ad litem fees in sarah carpenter pineda versus margot frasier et al, consultation with attorney. 37, ratify appointment of alicia perez, executive manager, administrative operations as county representative for mediation in eeoc charge number 36 a-2006-00200, errol hardin versus Travis County and consider and take appropriate action on settlement proposal. That's the consultation with on attorney and personnel matters exceptions to the open meetings act. And last but not least, number 38, one that we'll take first in executive session, by the way, consider and take appropriate action in response to order from the united states district court for the eastern district of Texas, marshal division, in league of united latin american citizens, et al versus rick perry, governor of Texas, et al, civil action number 203-cv-354 consolidated. And that will be taken up under the consultation with attorney exception to the open meetings act. We will discuss all of these items in executive session, but will return to open court before taking any action.


we have from executive session we discuss the following item. 32 regarding the medical examiner's office and the executive manager oversight role of alice ped is, move to reexten the role and the same level of compensation through the end of this fiscal year so that it be midnight, September 30, 2006.

Notify barin and add ler that the county will not be exercising its right to purchase the parcel under the commercial real estate contract forwarded to the county by seller. That's a. B, reservers its rate, the county does, to purchase the remainder of the add adjacent track pursuant to the contract between county and seller, bearing and ad er, and c of this three part , is to request, county requests that baron and a adler reimburse payment of $350 $350,000 to Travis County -- $50 Travis County at the time of closing.

I move that the authorize the county auditor to pay $1,387.50 in ad lite fees, and that is over the original 1,000 lotted by the Commissioners court, in accordance with the court order signed by the judge in this matter.

>> discussion all in favor. That passes by unanimous vote. The next case which is number 37 involving errol in versus Travis County. Move that we ratify the appointment of the attorney to represent Travis County in the mediation of the eeeeor charge, and two that we authorize the county judge to sign the proposed settlement agreement to resolve this matter.

>> any discussion? By the way, that we comply with the numerous terms and conditions set forth in that agreement. All in favor. That passes by unanimous vote. Number 38 is the matter involving the lawsuit filed by l lulac and other, including Travis County, against rick per perry and some others. And I move that the county through its legal representative submit remedial congressional re redistricting proposal to the u.s. District court that achieves a district, congressional district firmly anchored in Travis County consistent with historical treatment and affecting no more than six with an election conducted similar to the 1996 congressional remedial order by the federal courts.

>> looking at. Put Commissioner Davis's name in there. The four of us in favor with Commissioner Daugherty voting against. We thank our lawyers for that fine legal language. I mean fine language. Now, 82 is a matter involving designating deposition representatives in gdf realty, l lt d. Move that we point tnr employees kevin connolly and me linda malier as tract representatives for the purpose of a federal rule 30(b)(6) deposition in gdf et al versus united states, authorize the county attorney to designate areas of testimony for mr. Connolly and ms. Malier as proper.
