Number 26 to consider and take appropriate on realignment of an existing easement across west sign suppress hills subdivision that provides access to county's pogue springs preserve/hogge parkland reserve and accept dedication of the easement to the public.
>> the -- this actually has to do with the old access rights has went to what we call the pogue tract. There was an easement that comes in from state 71 to the hogue tract. The development west cypress hills actually platted on top of a portion of that easement and so it was somewhat compromised. And we realized as we were getting in to purchase the tract we needed to have that corrected. What's going on here is the -- the new development, which you are approving or have approved today, reroutes that access easement along the roads that have been platted so we now have eliminated the -- the conflict. By rerouting the county because we are now the owner of the hogge tract, have perfected the easement to the tract, which came with the purchase of that property.
>> what these documents do is basically rectify the alignment so there's no conflict between what has been platted and the easement that goes to the hogge tract.
>> any issues? Move approval.
>> second.
>> joe, the second part of it you need to understand is what t.n.r. Is recommend ing is that you not only accept the realignment of the easement, but when we closed on the hogge tract, the hogges prior to conveying to us dedicated this easement as a public right of way to the staff recommendation would be to accept it as a public right-of-way.
>> dedicate the easement to Travis County.
>> dedicated it to the public.
>> all right.
>> so the staff recommendation -- as part of the motion, if you take the staff recommendation, you are accepting the dedication of this easement so that it's a public right-of-way all the way from the boundary of the county land to where rhymers pea coke that connects with 71.
>> wasn't that our intention? Or hope?
>> it is -- basically, yes. It comes -- it comes with the hogge property. We want that right. We are making a public easement. The only issue here is whether we actually build a road within that public right-of-way, now or later. I think this is a decision that we basically will defer until we find out what we are going to do with the hogge tract.
>> is there a down side that we are not seeing or is it -- is joe's last point there what you want us to be mindful of.
>> well, I would say that -- that you are going to create a unique situation in that it will be a public right-of-way but there's not a road actually built in most of it. So if we don't accept it as public right-of-way, that means that we may not have use of it?
>> yes. What we are trying to do is basically tie down our rights now and we will deal with the road issue as we -- as we get a better idea of what we do with the hogge tract. Better to protect it now and decide at a later point no we don't need it as opposed to you don't get it and then all of a sudden you decide you do need it.
>> that's what you would be doing.
>> a detection of --
>> that's what you would be doing bicepping the staff recommendation.
>> by accepting the staff recommendation.
>> my motion stays in place legal. That wasn't seconded was it.
>> I'm seconding.
>> the -- did Commissioner Daugherty run from this item for some reason, joe?
