Executive Session Items

Now, we earlier indicated our intention to call up the taser item in executive session. And that is number 28. We will get answers to Commissioner Sonleitner legal questions. 35. Consider and take appropriate action on performance pay as a follow-up to recent performance evaluations and other compensation issues period of time for the four executive managers and the two coordinators. And that's the personnel matters exception to the open meetings act. We have been asked to postpone 36 and 37. 36 and 37. So neither one of those will be discussed. 38. Receive briefing and take appropriate action regarding recruitment of chief medical examiner and deputy medical examiners and related matters. That's the personnel matters exception. 39. Consider and take appropriate action on initiative to educate Travis County voters and conduct non-binding election on the -- we don't need that item. Let's not take it. 39 let's not take. We will have it back on. 40. Receive legal briefing and take appropriate action regarding james colby west. Consultation with attorney and personnel matters exception to the open meetings act. And so we will discuss those in executive session but return to open court before taking any action.

>> actually I wound up asking it outside when I came outside, could you all very quickly fill us in on how you document somebody going through training and recertification on this piece of equipment.

>> we have a certified instructor at our training academy. They have to turn into tcleose on the mandated hours, amount of training needed to be certified in the deployment and use of this device. That's ought done on our records at the training academy. And pushed forward to tcleose.

>> you have up to date records of what we are trying to put into the record.

>> carry the advice then through the proper training certification and passed it is class.

>> > by the way, last year is mandatory, we put every patrol officer through the training, looking forward to if we could get the -- more of the devices, went ahead and put through all of the patrol officers through the training, that are mandatory, so even somebody using it next to them, they are trained in it as well.

>> how many officers actually carry tasers?

>> 55 in law enforcement and about -- about -- about --

>> I think that we have 12.

>> 12 in corrections. In various facilities that they use.

>> Commissioner Sonleitner against. And Commissioner Davis had to run to another commitment and will miss the rest of this meeting. Number 40eus the james -- number 40 is the james colby west matter. We did get a briefing.

>> personally, I would move, you know, that we give two months of pay, two months of cobra.

>> two months of each?

>> uh-huh.

>> I’ll second that. That's the equivalent of -- of I guess about 10, $11,000 plus about -- about -- the cobra would be about 1100. A thousand or 1100. That would be an -- in exchange for full settlement of whatever claims he has against Travis County to get this matter behind us once and for all.

>> that's right.

>> I second that. Any discussion?

>> just a question, is that cobra for the employee only or is that a cobra for the employee only?

>> yes, that would be my motion to the employee only.

>> that's what the total would be. 500 plus for the employee. That's what I saw. Discussion? Favor favor? Show Commissioners Daugherty and yours truly voting in favor. Voting against Commissioner Gomez and Commissioner Sonleitner. That motion fails. We did not discuss -- let me call up another item right quick, we did not discuss -- the waste management item, let's call it up. That is number 16. We have mentioned this morning -- a motion that we wanted to -- to -- accompanied by a letter and mr. Nuchols did give us language, a few minutes ago to look at, we did not discuss this in executive session. But this morning promised to come back to it. I would suggest that we add the following second sentence to that first one. It is both parties acknowledge that Travis County has voted. To oppose waste management's application to expand it's landfill facility in northeast Travis County. And I’m thinking that if you read those -- those two together, to me it means a little bit more than not having the second sentence, so if it comes up over at tceq and there's any -- any disagreement about what the understanding was intended to be, this will be there. If they sign I think we're in good shape. If they don't, I think we've got problems.

>> judge, the only other thing that I had was to add to travis to your signature line rather than just saying county attorney, Travis County judge. Just --

>> sound fine to me. How is that sentence?

>> the motion this morning was to -- to approve the development permit and the letter. This is the letter.

>> okay.

>> so I move that we approve this letter to go with the motion that we approved.

>> okay.

>> with the second sentence added.

>> okay. Is that okay? Seconded by Commissioner Gomez. Discussion? All in favor? That passes by unanimous vote. If for some reason waste management doesn't like that second sentence, it will need to come back on the agenda before the perm is issued.

>> I move that we authorize the county judge to sign the letter on behalf of the Travis County Commissioners court after the west management signs it, I may even sign it before it go over there, sign it, if there's a problems put it back on the agenda. Is that all right? Any objection to that? Okay. Going back to the items listed to executive session, number 35, involves compensation issues for our executive managers and two coordinators.

>> judge, I would move that -- that in accordance with us having completed our evaluations of the executive manager, the two coordinators, the following pay in performance changes to their salaries for mr. Coalburn, pete baldwin they both get a 5% performance pay increase. For sherri flemming that she gets a $10,000 performance increase. And for joe gieselman, christian smith, alicia perez that their new salary be raised to $120,000 each.

>> discussion? All in favor? Show Commissioners Gomez, Sonleitner and yours truly voting in favor. Commissioner Daugherty against.

>> judge, if it's just for clarification that the source of those dollars, we believe each of them has it within their salary savings, within their budgets, there's a little bit left over of the two percent that I think was allocated. Hopefully that will take care of it. If they have issues they need to bring them -- aware of them.

>> if not allocated reserve.

>> if not. But we think everybody can handle it internally.

>> okay.

>> > we did give directions to staff on number 38 after receiving a briefing. We will have that matter back on next week just in case we need it because we are chatting with various applicants and there may well be the need for feedback. With that, we are done for today. Aren't we?
