Number 10-a, consider and take appropriate action on the request to approve a variance to chapter 82.401-c-4, standards for construction of streets and drainage in subdivisions to allow the acceptance of dedication of a portion of street and drainage facilities in seven oaks section 5, marly way and olympus drive. And 10-b is to consider and take appropriate action on the approval of the first amendment to the construction agreement with Bee Caves oaks development, incorporated.

>> good morning. Joe gieselman. We've had this item on the court agenda several times. We are coming today to recommend to the court to recommend acceptance of a portion of the seven oaks subdivision, two streets in particular, a section of marly way and then olympus drive within the seven oaks subdivision. These are not all of the streets in the subdivision, and therefore a variance is required to partially accept the subdivision. What this will do, the county's acceptance of these two roadways will then make a continuous thoroughfare through the subdivision to farm-to-market road 2244, the state highway. Thus enabling the adjoining subdivision to have access to the farm-to-market road. The developer has made substantial progress on the punch list that we provided to him. And we believe that many of the items that would be most problematic for the county have been taken care of, specifically the extension of the guardrail around some trees close to the travelway, as well as some perpendicular driveways that were not meeting our traffic standards. Even though the county will have accepted the roads for ongoing maintenance, which means the developer and not the county would be responsible for performing those within the public right-of-way accepted for county maintenance.

>> what's our leverage on b in the event that those -- that additional work is not done.

>> we still retain the fiscal for those items.

>> questions?

>> joe, I want to make sure we put in here that we do have an understanding with both seven oaks and the bluffs neighborhood that during the parade of homes that will take place in June that we do have the understanding that we will close marley and olympus during the hours of the parade of homes. I think both parties are understanding of that. I just want to make sure that we just --

>> we will go through the normal process to do that as well so that there would be a public hearing prior to closure and everyone will be notified of that.

>> I really appreciate the work that you've done on it and really appreciate both neighborhoods because this has been, you know, a bit contentious. Not unlike a number of subjects that we have here where you have competing needs and really competing desires. So I think that this is the best that we can do. I really do appreciate, beth, you and phillip gearing up and getting these things done for us and for the bluffs' people to understand that this is what we need to do to move forward. So I would move approval of both a and b, judge.

>> let me make one more statement also. If the court accepts the roadway, the county crews will be out there tomorrow to stripe the roadway and also we will post speed limit -- provisional speed limits until our traffic staff can actually do the necessary engineering studies to do a permanent speed limit. Those will be in place tomorrow.

>> anybody here against the court approving 10-a and b? If so, come forward and tell us why.

>> [inaudible - no mic].

>> you see the neighborhood together right there?

>> I think so.
