Executive Session Items

I have a couple of questions of the county attorney in executive session.

>> okay.

>> after we return, I will ask this court to put this matter back on the court's agenda next week early for action early on. I have a note here that says we can bump 33, 35, 36, and this note says 38. Several folk are here on 38, though, right?

>> is that the one with --

>> [indiscernible]

>> beg your pardon?

>> they are here on both.

>> all right. Let's bump 33, 35, actually instead of bumping 35, do we need to just go ahead and approve it? If somebody will tell me when. We need to extend administrative -- leave with pay 2. Just give us that. We normally don't get a whole lot of discussion anyway. Juvenile probation department.

>> [one moment please for change in captioners]

>> we'll convene in executive session. I did not indicate in executive session --

>> a-1?

>> okay. 35, consultation with attorney and personnel matters. 37, personnel matters. 38, consultation with attorney. 39, consultation with attorney. A-1, the matter involving our executive managers and a follow-up to recent performance evaluations. That's the personnel matters exception. We'll convene in executive session for them also. A-1. I’m thinking we can get that done in 60 seconds unless if a full discussion is required, then I think we can postpone it. We are losing one person at 6:00, and if we're not careful --

>> probably two, judge.

>> then let's go in executive session.

we have returned from executive session. We did not discuss a 1. Welt have that come the the court's agenda next week and hopefully reach it a lot earlier than today. Did not discuss 33, that will be back on next week as will 34. 35 did not discuss, we wanted to slot information, the date. 36 we did not discuss. We did discuss item no. 37. And we'll have -- two or three items on next week, maybe subparts, to deal with specific parts of this. Including a response to a letter that we got from dr. Peacock and addressing a letter of resignation we got from there, also, and some other issues. Number 38, the b.f.i. Landfill permit amendment application, we did get late word from b.f.i. That they wish to request postponement of their meeting with the capcog solid waste advisory committee scheduled to met on Thursday of this week. If they make the request, Travis County has no opposition. And I move that we -- that should be our position. Especially in view of the fact that one of our managers will not be able to attend that meeting and probably not a good idea to have the advisory committee simply meet for this one item, if they can avoid the meeting it's probably better for us. That's the motion. Discussion? By the way, Commissioner Daugherty had to run to another commitment about an hour ago. So he will be absent for the rest of this meeting, all in favor? That passes by unanimous vote.

>> judge, that's just a postponement so everybody understands it, it's just a postponement of the meeting of all of these -- going to be held as far as capcog, in other words, b.f.i. And capcog advisory committee, advisory committee, that's right, that's what that postponement is.

>> scheduled to meet the day after tomorrow.

>> make sure that everybody understands that. Don't want no ambiguousty, make that real clear.

>> if they contact the chair and indicate a request to postpone the meeting and we have no objection, it will probably be granted, you think, right?

>> I can send an e-mail to that effect in the morning, informing them of your vote.

>> makes accepts --

>> as many problems as they could in terms of if john is not going to be there, we are in serious disadvantage of not having our key people [indiscernible]

>> feel a whole lot better.

>> me, too.

>> I will send that to capcog.

>> and let our -- let residents who have been following us on solid waste issues know the outcome of that. Okay. 39 the -- the waste management of Texas landfill permit amendment application, we did approve a letter that staff presented to us after making a slight change of one sentence.

>> we need to approve it.

>> right. We approve that letter with that one change.

>> second.

>> and this is to be signed by the entire Commissioners court and that deadline for this is -- Tuesday, also?

>> Thursday.

>> needs to be at tceq by Thursday, we will hand deliver it.

>> they will hand deliver it. We will has that one change, have the original prepared on Commissioners court stationery and try to get that signed tomorrow for delivery late tomorrow or Thursday. That's the motion.

>> second.

>> and, judge, with that also make sure that the community as defined by the court members, that the community will have a copy of this particular correspondence.

>> that will be fine. I will be happy to give them my copy with that one change.

>> okay. That will be fine.

>> today.

>> [indiscernible]

>> probably better to give them a clean copy, judge.

>> if you would like a clean copy, you can have it tomorrow. I would give it to you today so you wouldn't be anxious on the way home. If you would rather wait for tomorrow, that's fine.

>> [indiscernible]

>> all right. Thank you. Thank you, judge.

>> no problem. All in favor? That passes by unanimous vote. We did discuss the collection of delinquent attorneys -- delinquent property taxes with our legal counsel, we had questions answered. It will be back on the agenda next week. There is one question that probably needs further research. The one dealing with the guarantee/reimbursement of fees/other issues there. And if we have other legal issues regarding that item, send them to you by e-mail later this week?

>> yes.

>> okay. Now, does that do it for this week's court meeting?

>> could we need to tell [indiscernible] 31 we didn't get to it, we will have to roll it?

>> well, on 31, carol cole coleburn, she and I had a discussion with christian and alicia, she put together a memo sort of summarizing what I discussed this morning. Let's look at that between now and next week. Maybe look at it and make some changes. We distributed that over lunch.

>> I haven't had a chance to read it, I was giving a speech over lunch.

>> we will have this item back on. Maybe try to refine what she put together and next week can he with look at that and take action.

>> that sounds great.

>> that's 31. I think we dealt with all of the other items didn't we.

>> move adjourn.

>> second.

>> all in favor? That passes by an enthusiastic vote of the Commissioners court.
