But 29 is to consider and take appropriate action on request to county contribution to and participation in the upcoming urban music festival, an african-american quality of life event. This is under the consultation with attorney exception to the open meetings act. Because it deals with legal advice.

>> judge, do we -- did we discuss 20?

>> no, we didn't. We need to go back and get that done. Lt me finish announcing executive session and we'll go back and pick up 20. That was a court companion item to what we discussed on the housing finance corps today. 31 is to consider and take appropriate action on initiative to educate Travis County voters and conduct nonbinding' election of the toalg of new lanes adding to existing state roads in Travis County. That's the consultation with attorney exception to the open meetings act. 32, consider and take appropriate action on the following medical examiner's office issues: a, terms and conditions of supplemental employment contract and performance measures for medical examiner and deputy medical examiners. B, hiring contract pathologists to temporarily meet demand for autopsies. And c -- all of this is under 32 -- status report on discussions with medical examiner. This is posted under the consultation with attorney and the personnel matters exceptions to the open meetings act. 33, consider and take appropriate action on the following regarding: a, request for real property negotiations on bob wentz park at windy point. And 33-b, request to negotiate a more cooperative arrangement with bob barstow regarding use of court ordered easement. That's posted under the consultation with attorney exceptions to the open meetings act. We'll discuss those matters in executive session and will return to court before taking any action.

earlier this afternoon I should have indicated that on number 20, which we took up under the housing finance corporation, which is to consider and take appropriate action on a fee reimbursement agreement, for Briarcliff or brair creek section 4 in present one, I move approval.

>> second.

>> discussion? Ahfc? That passes by unanimous vote. Number 29, a matter involving the upcoming urban music festival. The african-american quality of life event, I move that we indicate our support of the decision of constables one and three, to assist by providing security and I guess to that extent any other constable that decides to sign on to help beef up security for this program. And I -- to indicate to the constables if they run short of funding in the overtime line items that the Commissioners court will be equally supportive.

>> second.

>> discussion? All in favor? That passes by unanimous vote. The second motion is for us to financially support this program by asking the board of directors of the Travis County housing finance corporation to make available a cash contribution of $15,000, that we carve out a specific county authorized purpose for this and that we have the matter on the agenda of the Travis County housing finance corps next Tuesday for -- for further action and consideration.

>> second.

>> seconded by Commissioner Davis. Any discussion? All in favor of that motion? Show Commissioner Davis and yours truly voting in favor. Voting against Commissioner Sonleitner, daughterty and Gomez. Number 31 is a matter involving county attorney's office. We did get an update, we will have it on back next week for follow-up consideration. I will have a few matters to call to the county attorney's attention now and then so they can brief us appropriately. Number 32 involving the medical examiner's office, we did have a chat with the chief medical examiner as well as a follow-up discussion of issues that we discussed previously. Ed and received from the medical examiner a letter of resignation and his -- his -- dated April the 4th, 2006. Which now I guess is a part of the public record. Any need for any action today? We do need to authorize the county attorney to go ahead and execute with doctors dana and fernandez appropriate contracts for them to provide autopsy services to Travis County on an as needed basis. After those are signed to bring it back to the Commissioners court for approval.

>> and to authorize that this can be exempt from the appropriate -- citing the appropriate chapter of the county purchasing act, because we are talking about the acquisition of [indiscernible]

>> right. Dr. Ray fernandez and suzanna -- dana. Right.

>> dana.

>> was that seconded?

>> yes? Discussion? All in favor? That passes by unanimous vote. By the way, the authorized -- another motion is to authorize the county attorney to complete the preparation of an appropriate contract with our chief medical examiner, along the -- the same terms and conditions that we discussed the most important of which I guess would be effective --

>> may 1.

>> may 1, 2006. Letter the resignation. And -- and basically requiring a set salary and elimination of the -- of the autopsy fees on out of county autopsies. Any other appropriate terms and conditions. That will be presented back to the Commissioners court before -- before may 1, also. That's the motion.

>> second.

>> discussion? All in favor? That passes by unanimous vote. Number 33, the matter involving the letter from bob barstow regarding bob wentz park at windy point, let's ask john hilly to respond to mr. Barstow, he has agreed to do so. Anything further on this?

>> huh-uh.

>> no.

>> 34, we did not discuss and indicated earlier that matter would not be discussed in executive session. 35 the matter involving sarah carpenter-pineda v. Margo frasier, et al, move that we authorize the county attorney to move this matter from federal court to state court and to enter into an appropriate agreement that protects Travis County's right to raise any and all defenses as appropriate in other appropriate terms and conditions. At the appropriate time a settlement agreement be presented to the Commissioners court. Last week we talked about -- we did authorize settlement in the amount of $75,000. Plus any court set attorney ad litem fees.

>> second.

>> discussion? Will that cover it?

>> sure enough, uh-huh.

>> all in favor? That passes by unanimous vote. We did not discuss 36. We previously announced it would not be part of -- of our -- of our executive session discussion. But will be back on the court's agenda in the future if necessary. We have to see the settlement papers at some point. That does it for today.

>> move adjournment.

>> all in favor? That passes by unanimous vote.
