Travis County Commissioners Court
April 4, 2006
Item 29
There is 29. Byron marshal is here and he did send us a letter that you should have gotten yesterday. Let's take that into executive session. Byron, do you have anything to say before we go in there? There is a question of legal authority. Let me suggest to the court that it would help me to try to help them by agreeing to facilitate the assistance of the precinct 3 and precinct 1 constable offices with security. The city of Austin park police are providing security and they have sent notification that they need 10 deputies and one sergeant really from 2:30 to 10, which is eight hours, on April 8th, and both constable offices have indicated a willingness to help out, but both have also indicated that they think they will run out of money before the end of the fiscal year if they pay overtime and don't get reimbursed. And so the question is whether the Commissioners court can authorize basically overtime compensation for deputies to be used in this manner legally. So that's the question. And to be honest, one of the constables indicated that he thought his budget was in good shape, the other one indicated he thought he may well run out. So they may be affected different ways. The other question is in terms of financial assistance, if the Commissioners court cannot do it legally, whether the Commissioners court would ask the Travis County housing finance corporation to participate to the tune of $15,000 subject to the corporation having the money available? And if the answer to that is yes, it may well be that we don't get the answer until next week anyway. We can't make the ask until next week. That money will not be available until a week after the affair, so if needed fine,, if not needed, then we would understand. So if we get legal advice and come back in here and hear the court's opinion on that. That idea came to mind when I heard something about Davis said this morning. Obviously he would have to make a careful review of the housing finance corporation's books and that would have to be placed on next week's agenda.
