Executive Session Items

I believe that brings us to executive session. Doesn't it? 37 is to receive briefing from county attorney and authorize county attorney to accept, reject or make counteroffer to the counteroffer settlement demand and take appropriate action regarding tnr employee, slot 528. That's the consultation with attorney and personnel matters exceptions to the open meetings act. 38, receive briefing from county attorney regarding negotiations and take appropriate action involving landowners james l.lozier and della l. Lozier, parcels four and five, el roy road project, consultation with attorney and real estate exception to the open meetings act. 39, consider and take appropriate action regarding the purchase of an office building located at 5555 airport boulevard, consultation with attorney and real estate exceptions to the open meetings act. And number 40, receive briefing from county attorney and take appropriate business regarding angela d. Stedler versus Travis County et al, consultation with attorney exception to the open meetings act. We will discuss these four items in executive session, but will return to open court before taking any action.


we have returned from executive session where we discussed the four following items: 37, regarding the tnr employee occupying slot 528

>> judge, I recommend we reject the counter offer and counter the counter in the ammount of $500 for tnr employee slot 528 to do with as he pleases.

>> judge, I guess we need -- I move that we accept the counter of $88,469 and 25 cents.

>> I have the contract and I’ll take it [indiscernible] [inaudible - no mic] for you to sign.

>> 38.

>> okay. That would be fine. 39 involves the potential purchase of property located at 5555 airport boulevard. We did discuss various issues. I guess the biggest one is regarding the seller's offer to pay a small amount of money toward the -- the roof repairs. I move that we -- based on -- based on the per square foot price, of this property, that we accept that -- that offer of assistance. And that -- there were a couple of other small matters. All of these would be rolled into second amendment in some form. So I move that we approve the second amendment that contains -- basically the provisions that we discussed.

>> there are other actions that need to be taken over the next few weeks as we move towards a closing on this matter. And including a -- a letter that -- that legal counsel is putting together regarding objections. Move approval of that, also. Anything else on this item?

>> yeah.

>> discussion? All in favor that passes by unanimous vote. Number 40, I move that we recess until 4:00 this afternoon to give -- to give the assistant county attorneys working on -- on the stedtler versus Travis County lawsuit an opportunity to contact the other service, if necessary communicate with the district court, we will come back at 4:00 to get updated and see if further action needs to be taken today. So the motion is to recess until 4:00.

>> good afternoon. Let's call back to order the voting session, the Tuesday, February 28th, 2006 voting session of the Travis County Commissioners court. We did recess one item about a little bit more than one hour ago or less than one hour. And that was number 40, receive briefing from county attorney and take appropriate action regarding angela d. Insteadtler versus Travis County, et al. This is an executive session item that we discussed in executive session under consultation with attorney. And I just remembered that I loaded up the executive session discussion equipment as I normally do. I didn't think we were going back in executive session, but if we need to, we can. We need to consult with our lawyers again on this matter, so we'll do so under the consultation with attorney exception to the open meetings act, and after our discussion we'll come back to open court before taking any action.


we have returned from executive session where we discussed item number 40 alone. And I move that we authorize the county attorney to settle this matter with the plaintiff for the amount of $22,500.

>> I move further that we authorize the county attorney to dismiss this lawsuit, our lawsuit against the eye bank hopefully with permission of the federal district judge without prejudice, but if the permission is not granted, then with prejudice. So the second part, the dismissal, is in the alternative, without prejudice if possible, if not, with prejudice. And that we further authorize execution of appropriate settlement agreement of the documents to be signed by the county judge as long as they're consistent with this motion, and if the court needs to address those documents further, we'll put it on the agenda. We'll have it back next week just in case. Is that okay? Seconded by Commissioner Gomez. Any more discussion? All in favor? That passes by unanimous vote.

>> move to -- I inadvertently forget to mention a person when I mentioned recognizing a person during citizen communication as far as black history, as far as the black firefighters that were first hired on, early on with the a.p.d.
