Now, we do have one or two questions for tom nuckols on number 31, the construction of sidewalks in the -- in the subdivisions policy. So we will take that into executive session under the consultation with attorney exception to the open meetings act. Posted for executive session discussion are 39, 39. Receive briefing from county attorney and take appropriate action concerning the extension of administrative leave for Travis County counseling & education services department employee, slot 9. Consultation with attorney and personnel matters. 40. Consider and take appropriate action regarding the purchase of an office building located at 5555 airport blvd., Austin, Texas. Personnel -- this is the real property exception to the open meetings act. And is that the right address? On number 40?

>> okay. Thank you, that through me off, I was worried. Real property exception to the open meetings act. 41. Receive briefing from county attorney and take appropriate action concerning the extension of administrative leave and related issues for Travis County facilities management department employee, slot 126. 126. That's the consultation with attorney and personnel matters exception to the open meetings act. And number 4 did, is to -- 42, to consider and take appropriate action on decision to hire a chief administrative officer for the Travis County medical examiner's office. And that's the personnel matters exception to the open meetings act. Let's also announce the -- the consultation with attorney for number 42, also. Just in case we need it. We will discuss these matters in executive session but will return to open court before taking any action.


good afternoon. We have just returned from executive session where we discussed the following items. Number 31 involving subdivisions and the design and construction of sidewalks or the failure to do so. We did get legal advice, and in my view no action required at this time. This matter will be back on the court's agenda next week for a follow-up discussion, and hopefully appropriate action. We discussed number 39, which involves the Travis County counseling and education services department employee in slot number 9. I move that we authorize extension of leave with pay until February 28th, 2006.

>> discussion? All in favor? That passes by unanimous vote. Number 40 involving the property at 5555 airport boulevard. I move that we approve the proposed first amendment to agreement of purchase and sale, which corrects a minor problem found with the legal description. We have already given staff, but included in this motion also further direction, as given in execution to follow-up on the due diligence issues, specifically dealing with the roof and any others of significance. And third, that we try to work out with the seller the encroachment issue that we discussed. Should we have this item back on the court's agenda next week in the event that we need it? And we'll have it back next week just in case we need it. That motion was seconded by Commissioner Davis. Any more discussion? All in favor? That passes by unanimous vote. We previously announced that Commissioner Daugherty left at about 3:00 on other county business, has not been with us since. 41 involves request to extend administrative leave for Travis County facilities management department employee. In slot 126 specifically. I move that we authorize leave with pay back to December second, 2005. Further, that we order reinstatement effective February 21st, 2006, and that we authorize the county attorney's office to get with this employee and other appropriate county staff to prepare the appropriate release and settlement agreement.

>> seconded by Commissioner Gomez. Any more discussion? I think that pretty much covers all of it. All in favor? That passes by unanimous vote. And we discussed number 42, which involves one of the applicants for the chief administrative officer physician in the Travis County medical examiner's office. I move that we authorize the hiring of our top applicant, elizabeth devery, with her first date of employment with the county to be March 6th, 2006, and at a beginning salary of $95,000.

>> just to work with all appropriate folks, hr, etcetera, in terms of preparing the necessary paperwork to get through as a paf and to get her properly educated, etcetera, in terms of coming on board as a county employee.

>> we will work with ms. Perez after her return, hopefully that will be real soon, and get that done. And make sure that mrs. Devery knows that whatever the Commissioners court can do to facilitate her orientation, we will be more than happy to do it.
