Do we have an agreement on number 25?

>> Commissioners?

>> yes or no?

>> we do have an agreement to not take the plat forward today. But to ask the court to authorize t.n.r. To issue a development permit conditioned on there not being any occupancy of the building until there is a plattary. Either mr. Dennin's plat or mr. Polson's plat and have this done within 90 days. A plat, either/or.

>> both parties agreed to that?

>> yes, sir.

>> is there an appropriate order have that captures that agreement?

>> one being worked on?

>> make a motion that t.n.r. Can issue the development permit without the plat being approved first. That will do the trick. I hadn't anticipated the need for a written order.

>> state that motion and I will adopt it and move it.

>> authorize t.n.r. To issue the development permit to mr. Dinneen, conditioned on no occupancy of the building until his lot is platted either by his own plat or by the hazy hills office park plat.

>> there's agreement on that.

>> yes. Commissioner and judge, I would like to say on behalf of the developer, polson investments, we really appreciate your providing staff time to help work this out. We have resolved some of the important issues that will allow both sides to at least move forward with their plats and their projects and we still have some issues to resolve, but we will save that for another day.

>> stated my motion.

>> second.

>> if I make sure as well that we understand that -- that the plat will be granted based on either mr. Polson finishing his aspect of what he had agreed to do or within 90 days I would be able to plat on my own if he hadn't completed that. Just wanted to make sure that's clear.

>> yes.

>> okay. Very good.

>> that's right, isn't it?

>> yes.

>> that's what I’m looking for is ana doing her thing.

>> any more discussion of terms, of my motion? Of tom's? Or my motion. All in favor? That passes by unanimous vote. Thank you all very much. Thanks for getting together, too.
