Executive Session Items

Do you want to go into executive session and get as much done as we can? Okay, then we will discuss this item further in executive session, for the record this is item 36. It will be under the consultation with attorney in executive session. We have asked several legal questions that I’m sure tom noted and will answer for us. 33. Receive legal advice and take appropriate action on Travis County authority regarding child, inc. And related federal child care funding for Austin and Travis County residents. Consultation with attorney. 34. Receive briefing from county attorney and take appropriate action and/or consider settlement offer in sarah carpenter-pineda v. Margo frasier, et. Al. Consultation with attorney. 35. Consider and take -- 35 postponed earlier. 36 bejust discussed at length and noirksed before that discussion. 37. Receive briefing from county attorney and take appropriate action in fredrick pluet, (deceased) v. Margo frasier, et. Al. Consultation with attorney. 38. Receive briefing from county attorney regarding state comptroller's audit and take appropriate action. That one is the consultation with attorney exception also. We will discuss these matters in executive session. But will return to open court before taking any action.


we did have our executive session discussion of various items we announced before we went into executive session. 33 involving child inc., other child care issues, no action required today unless a member has something else in mind. 34, we did get a briefing on. No action required today. This one will be back on the court's agenda next week. Just in case we need it. Did not announce 35 and did not discuss it. Item 36 we did discuss, that was the matter we discussed at length in open court. And we did give directions to staff to put together a list of the specific recommendations, what we call comments generally. To share with mr. Swinney and also the business owner, mess rodriguez who came to court today. In my view, no further action required there, other than working with them this trying to conclude this matter. Anything else?

>> we have got a briefing on 37. But no action is required today. We were told to pull that item until further notice. So when they need it they will put it back on. 38 regarding the state comptroller's audit and a claim, we got a briefing on that one and I move that we follow the staff recommendation and pay the claim made by the Texas comptroller against Travis County in the amount of $190,556 and a nickel, five cents. And that we direct that the source of funding for this amount of money be the errors and omissions fund which will pay for most of it, but not all of it, the balance will come from the risk management fund and that we basically request staff to make this payment immediately.

>> judge, I think the only other thing was that leroy was asking us to process any movement between line items as an automatic transfer. That would just make it easier in terms of the direction of where it came from to go through as an audit.

>> there you go. Well, it doesn't just become automatic because it is automatic. They wanted direction that it is automatic as opposed to it has to be on our budget amendments and transfers next week.
