We did have one citizen to come in after we announced for citizens communication, that's tom jones. Not related to the singer tom jones [laughter] the original tom jones.

>> this item allows residents to address the court on any matter not on the agenda. Mr. Jones if you will have the there, give us your full name just for the record, we will be happy to get your comments.

>> my name is tom jones. I am appearing before you today as the president of the [indiscernible] creek neighborhood association. We have a situation out in Travis County where there is a roadway that's been under construction for several years now, but has failed to open to the public. It's marley way in the seven oaks subdivision. I represent the neighborhood that's behind it. We have a public safety issue with this road not being opened. There's some questions of whether or not the road is in public domain right now. If -- if it is in public domain, we would like to go ahead and open the barricades that are barricading this street that's preventing us from using the street. If it's not in public domain, we would like for Travis County to draw down to the physical posting that the developer has, go ahead and finish the road for them. In my conversations with the developer, several months ago, he stated that he didn't have enough gas money to -- to hire trucks to haul the fill out, so he can't finish the roads. This has been an issue for several years for us. We have been promising that roadway is going to open, by numerous county officials for several years, it's never opened. I have sent you all a letter several months ago. Which I hope that you will have some memory of, asking that this road be opened. We have a very clear -- very clear public safety issue. And that when these roads freeze over, even when it's wet, no vehicles, emergency vehicles, trash vehicles, propane trucks, ambulance, fire trucks, et cetera, can't get into the subdivision. Every year we put a big [indiscernible] of sand at the top of the hill so the neighbors can spread sand on the streets so we can gain access. During the past month, we've had a hummer, one of our fighting vehicles, stall, consumer cars flip over. No series injuries out there so far, but we've had numerous accidents, serious injuries. We are afraid there's going to be a fire, medical emergency, ambulance, that's going to cause property damage, put lives at peril. We would like to put this on the agenda if one of you would sponsor this. We would like to invite the developer to come speak about this. If they intend to take this road private, we would like to object to that. Otherwise we would like to see this road opened immediately. Commissioner Daugherty, I apologize for what -- it's time to get this in the public forum. There's been -- it's been several years now that the road has been blocked off, we would like to see some action on it.

>> okay. We will get an update from our transportation director real soon and either put it on the agenda or take other appropriate action.

>> I do appreciate your time.

>> we appreciate your coming down, we have your phone number here, so you will either hear from swroa or one of us within -- joe or one of us within the next few days.
