2. Receive comments regarding a request to authorize the filing of an instrument to vacate a portion of the old bee cave road right-of-way, in precinct three. This is the vacation of right-of-way. That is not needed by the county or the state and -- and all of the utility companies were contacted in the area and -- and six of the seven said that they did not need it. The 7th, the Travis County has stated a need for the water line easement which is described in the attached field notes. We will accept that from the vacation, so they still can use it for the water line. Otherwise we recommend the -- the vacation of the right-of-way so that it can be used by esd for a fire station.

>> that's right.
>> in the backup? Is that in the order that we have to sign today?
>> we basically said the vacation doesn't take effect effect -- until the owner wants the water line easement.
>> does the court sign any kind of order today.
>> yes.
>> will it have that condition in it?
>> yes.
>> would anyone like to give testimony during this public hearing?
>> move to close the public hearing.
>> second.
>> all in favor? That passes by unanimous vote. This will be action item no. 8 on today's agenda.
