Executive Session Items

Now, we are ready for executive session. We discussed this morning involving a, b, c of the sweetwater development, there is a list of legal questions to ask of mr. Nuchols, so we will do that. We don't need to read the whole item do we?

>> okay. And posted for executive session discussion --

>> number 10.

>> under consultation with attorney. 10, real estate -- 17, it was 16, right? 16. Consider and take appropriate action for the potential purchase of real estate in central Austin. 2 17. Receive briefing from county attorney and take appropriate action and/or consider settlement offer in fredrick pluet, (deceased) v. Margo frasier, et. Al. Civil rights case. Consultation with attorney. 18. Receive briefing from county attorney and take appropriate action in murray, et al. V. Earle, et. Al. No. A-02-ca-252-ss. Consultation with attorney. And our final item for discussion today, will be 19. Receive briefing from county attorney and take appropriate action and/or consider settlement offer in sarah carpenter-pineda v. Margo frasier, et. Al. That's the consultation with attorney exception to the open meetings act, also.

>> manchaca?

>> yeah, we will need number 5. Manchaca fire hall. 5. Consider and take the following actions regarding county-owned property at 1310 f.m. 1626: a. Terminate lease to manchaca volunteer fire department (mvfd) and accept transfer of water well permit from mvfd; manchaca volunteer fire department, b. Grant license for main station truck bay to Travis County emergency services district #5; and c. Grant license agreement for operation of community center to clarence vogel. It indicates there that this item may be called up into executive session under consultation with attorney to open meetings act we will do. We will discuss these but we will return to court before taking any action. We will discuss 16 -- we may have said 10, but it's really 16. We tried to correct that after we -- [laughter] are you highlighting the county judge's mistake today?


>> we have finally returned from executive session where we discussed the following items: 5 a, b and c regarding the -- [ phone ringing ] man shack volunteer fire department -- manchaca volunteer fire department owned by Travis County.

>> judge, I would move approval of a, b and c. Discussion? Favor favor? That passes by unanimous vote with Commissioner Davis temporarily off the dais. We also discussed number 10 at length. We previously committed to have it back on the court's agenda next week in the event that we are ready for action. Maybe a good idea for Commissioner Daugherty and me to sit with the applicant and his representatives later this week, maybe before next week, try to talk through some of these issues and see if there's any way for us to -- to expedite our consideration. And next week's meeting. Any action on this today?

>> huh-uh.

>> nothing else.

>> okay. Then we discussed the items that are posted for action, 16 we did get an update on that involves the potential purchase of real estate in central Austin. Any action today? 17 involves the fred dick pluet versus margo frasier and others litigation. Any action today?

>> I would move that we reject the offer to settle in the amount of $300,000 and authorize the county attorney's office to contacts and have on stand by outside counsel in the event that is necessary.

>> and we did authorize the county attorney to be ready to -- to contract with the -- those lawyers, the four that were named to represent various defendants associated with Travis County in the event that the lawsuit is filed, that ought to be part of that which they asked for. Okay? Is that friendly?

>> that is way friendly.

>> okay. Discussion? All in favor? That passes by unanimous vote. We discussed the -- the number 18, the murder right and others verse earle and others litigation. Any action today.

>> do we have sufficient direction to file all appeals appropriate that the county attorney's office --

>> I do know there's supposed to be a motion for summary judgment hearing before -- heard by the federal judge in this matter on Friday, I thought. And the other appropriate action that they believe is necessary regarding the 12 c motion, which is a little different than the -- than the summary judgment one.

>> any and all necessary actions that the county attorney's would suggest to protect Travis County's legal position.

>> we'll have that one back on next week just in case. Maybe have number 17 back on, also. Okay? I don't think there's anything more specific than that. Can you think of anything?

>> I don't think so. More directions. I think that you were -- strategy.

>> okay.

>> 17 we did get a briefing on, need it back on next week.

>> 19.

>> 19, rather, depending on what happens later this week. Anything further on that today?

>> move adjourn.

>> then we are at the end of our meeting, motion to adjourn and a second. All in favor? That passes by unanimous vote.
