Executive Session Items

Let's go to executive session items and try to come back before lunch and do the rest of the voting session agenda. Including 36. 38, consider and take appropriate action on proposed second amendment to the lease agreement concerning property in south Austin. That's the real property exception to the open meetings act. 39, receive briefing from county attorney and take appropriate action regarding settlement offer in Travis County medical examiner's facility case. Consultation with attorney. 40, consider and take appropriate action on temporary assignment of chief administrative officer in medical examiner's office. That's the personnel matters exception to the open meetings act. 41, consider and take appropriate action for the potential purchase of real estate in central Austin. That's the real estate exception to the open meetings act. And 42, receive briefing and take appropriate action in entertainment by j and j incorporated versus rufino cornejo and luke mercer, constable precinct 1, et call. That's the consultation with attorney exception to the open meetings act. We will meet in executive session to discuss these items --

>> 38 will be also under consultation with attorney. So that's consultation with attorney and real property exceptions to the open meetings act. For number 38. We'll discuss these in executive session, but will return to open court before taking any action.


we have returned from executive session where we have completed some of our discussion this morning. I move that we recess until 1:45 this afternoon.

>> all in favor? That passes by unanimous vote. The whole court, three of whom you see, and two of whom you don't.


now, this morning we did cover some of our executive session, but we did not get to all of them. John told me that we do not need item 41 regarding the real estate in central Austin, right, john? 41 we don't need. But we do need to discuss the only other item left, and that is number 40, consider and take appropriate action on temporary assignment of chief administrative officer in medical examiner's office. And that's the only one we need to announce because we have discussed all of the others. So we'll discuss 40 in executive session, but we'll return to open court before taking any action.


we have returned from executive session where we discussed the following items: number 38 involving property in south Austin. I move that we approve the proposed second amendment to the lease agreement.

>> discussion? That deals with the modification of one of the county's rights as well as the landlord's commitment to make certain lease payments to us because of our ability to move in has been delayed. Discussion? All in favor? That passes by unanimous vote. While we did discuss number 39 briefly, we'll have it back on the court's agenda next week, hopefully with some language of our own. And the standard county language to compare to the language proposed by one of the attorneys for the other side in that controversy. Number 40, I move that we extend the temporary assignment at the medical examiner's office of alicia perez for an additional 90 days.

>> and will that cover it for us? Anything else? Same terms and conditions, and we'll have that matter for discussion on a work session agenda January 19th, is the second one in January. The first one is the 5th so the second one must be the 19th, two weeks later. Discussion? All in favor? That passes by unanimous vote. 41 we did not discuss. We'll have it back on the court's agenda next week. 42 we discussed in part. We'll have that back on the court's agenda next week also for any appropriate follow-up action, counsel will do additional analysis on that, maybe give us something in writing to look at as we attempt to work our way through this item. Maybe a good idea to post both of those matters involving the con strabls next week -- constables next week so we can discuss both of them. Anything else today?
