Consider and take appropriate action for the potential purchase of real estate in central Austin, that's the real property exception to the open meetings act, also let's announce the consultation with attorney exception. 55. Receive legal briefing and take appropriate action on request for information from project dual regarding financial incentives under county financial incentives program policy. Consultation with attorney. 56. Receive legal briefing and take appropriate action on tax rebate agreement with samsung Austin semiconductor llc. Consultation with attorney. 57. Receive legal briefing and take appropriate action on tax abatement agreement with home depot u.s.a, inc. Resultation with attorney. 58. Consider and take appropriate action regarding request from bob barstow for real property negotiations involving bob wentz park at windy point. Consultation with attorney. And on 59, I indicated to judge kennedy that we would call that item up this afternoon. But let's announce it just in case we can cover some of the discussion without her. 59. Consider and take appropriate action on request to convert bailiff position to a certified peace officer in the 403rd judicial district criminal court for security reasons. That's the security exception to the open meetings act. We will discuss these matters in executive session. Under the announced exceptions to the open meetings act, but will return to open court before taking any action.
we have returned from executive session where we completed discussion of part of the items, but not all of them, we will have to go back into executive session this afternoon after the corporations. Move that we recess until 1:30.

this morning we did get about halfway through our executive session items, but we have a few to go, including I see we have ms. Hale and judge kennedy here, and that is number 59 which involves converting a bailiff position to a certified peace officer position. That's the security matters exeps to the open meetings act. We will also need to discuss 58, which involves a request from bob barstow regarding bob wentz park at windy point. We did discuss 57 and 56 and 55, we've taken those in reverse order. Maybe a brief discussion of number 54, which involves the potential purchase of real estate in central Austin. That's the real estate exception. We announced numerous resale deeds, item number 50, 51, 52, 53, all of those are posted with consultation -- under consultation with attorney exception to the open meetings act. And we've already discussed number 49, 48, 47, so we don't need to discuss those again. But we need a brief discussion of number 46, which involves legal questions regarding child incorporated and related federal child care funding for Austin and Travis County residents. And so we will convene in executive session to finish our discussion that we started this morning. But we'll come back to open court before taking any action.
we have just returned from executive session where we discussed the following items. Number 46 we had a brief discussion. We'll need a follow-up discussion in two weeks, I知 told. Two weeks from today is January 3rd. We'll have it back on then. 47 that involves three leases with the central parking system of Texas, inc, I move that we approve the recommended contracts for two years. They are at the same rate, no increases. The first one covers 25 spaces. That's on san antonio. The second one five at 1250 guadalupe. The other one 1300 guadalupe. The annual cost is 42,000. The rest of this career is 31,500. Move approval of all three.

>> discussion? All in favor? That passes by unanimous vote. Number 48 involves the ongoing litigation in the congressional redistricting matter. We did get an update. I move that we authorize the payment of an additional $30,000 from allocated reserves to legal con sell and that we -- con sell and we be presented an appropriate contract modification as soon as it can be prepared.

>> okay.
>> this is to carry out the continued litigation for the congressional redistricting as this case comes before the united states supreme court for those wondering about this. But I do second that motion and modify the contract with the approval of the court for the $30,000.
>> any more discussion? All in favor? That passes by unanimous vote. We discussed number 49, received an appropriate briefing. In my view, no action required today. That will be put back on the court's agenda when there is action that's necessary. Number 50 involves the proposed tax resale deed to marlon torres and I move that we authorize the county judge to sign the prepared tax resale deal to mr. Torres who has paid Travis County the sum of $8,500 in cash. Any discussion? All in favor? That passes by unanimous vote. On item 51 I move we prepare the deed to deborah surber who has paid the sum of $3,050 in cash. Discussion? All in favor? That passes by unanimous vote. On item number 52, I move that we authorize the county judge to sign on behalf of the Commissioners court the proposed tax resale deed to allstate investments, ll crrks which has paid Travis County the sum of $4,960 in cash.

>> one deed. The amount is $4,960. But there's a tract 1 and tract 2.

>> the one that's $4,960 is 20810 galloway. That would be the second one.
>> tract 2. All right. So the $4,960 is tract 1. Tract 1 the sum is $6,132 and there will be two -- we will authorize the county judge to sign those and withdraw the other motion. Substitute that one for two tracts. Is there a second?

Now looking at the tax resale deed for item number 53, I move that we authorize the county judge to sign this proposed tax resale deed to mount lago vista, l.l.c. Now I see what's in the agenda item. We've got amounts down here. The amounts track the a, b, c in the agenda?

>> so for the first one it will be to george a. And carol a. Luber who paid Travis County the sum of $3,791.63.
>> mount lago vista is the only bidder on all these tracts.
>> okay. And they are from -- if we just say a, what if I call the billing number that's in the deed. Is that okay?
>> that would be okay.
>> do I need to read all of these into the record?
>> for the -- following the amount, can you give her a copy?

>> all amounts will track the item numbers.
>> one, two, three, four, five, six, seven, eight. One, two, three, four, five, six, seven, eight. The proposed deed will have eight specific tracts. As the agenda item says, these are persons from whom the property is taken at foreclosure, and all of them are sold to mount lago vista, l.l.c., and the amounts vary. And they are specifically set out and respectively set out in the proposed resale deed and we'll just hand this to the clerk right now. Move approval of all of that.

>> that will have all of these -- actually got billing numbers, but they will be from these individuals. 54 we did not discuss. We'll have it on the agenda next week in case we need it. 55 we discussed very briefly. No, we don't. No action taken. 55, if we can find out between now and tomorrow whether we need it back on the agenda next week. 56 we did discuss briefly and 57. 56 involved samsung, 57 home depot. Move that we authorize the county attorney or assistant county attorney who has been negotiating with lawyers for both of these companies to follow the directions we gave which basically is upon her recommendation and hopefully on both of these we'll have a final contract to execute tomorrow or the next day. Discussion? All in favor? That passes by unanimous vote. And that brings us to item 58. Move we authorize the county judge to sign the letter to lcra regarding the request from bob barstow after the changes that we recommended have been incorporated, and if there are issues with those changes, we'll have this matter back on the agenda next week. But if not and the recommendations are simply incorporated, the county judge will sign the letter and send it.

>> discussion? All in favor? That passes by unanimous vote. We discussed number 59, the request to convert a bay live position to certified peace officer for the 403rd judicial district crim court. Move that we grant the request and ask the sheriff and the judge to get together and ask county staff to have us execute the appropriate forms to approve this in the future. The intention is for us to take the salary savings from the bailiff position and fund as much of the certified peace officer position for the rest of the fiscal year as possible.

>> this would also generate a p.a.f. And would need to be placed on our agenda in terms of a personnel amendment and they would work with h.r. To make that happen.
>> right. Discussion? All in favor? That passes by unanimous vote. This morning we did not discuss one item. And that was the one involving a letter to the department heads and officials regarding preparation for the next regular session of the Texas legislature. We did have a draft letter sent to us by bob cam, and I have made several sort of minor changes on my draft. Are there any big changes we need to discuss in court? Because my recommendation would be -- by the way, I do recommend that those proposals be sent to ann dinkler instead of the court. Is she still the liaison?
>> she is not on maternity leave. Yes, she is still here.
>> have them sent to one place and she has done stuch an outstanding job, rather than send them to us or the consultants.
>> we are happy to be the funnel.
>> what I have in mind is us taking a glance at them and deciding at that point whether we need a follow-up work session or just post them on the Tuesday voting session agenda. But I think we ought to decide which ones we want the consultants to work on and we can prioritize them, that would be good too. The other thing is our consultants have recommended a legislative proposal form which I assume we would pass that on and ask departments to try to reach also. My changes --

>> my recommendation is that we give our managers and officials one month to hopefully get it together. So if we set a deadline, I have a deadline of February 1, 2006.

>> I think after the holidays that will leave a little bit more than three weeks of real work time and they ought to be able to get it done. What I was about to suggest is rather than go through these minor changes in court, if there are major changes we may need to discuss thet. But if we can get these to a certain person, if you get them to me, I値l try to incorporate the changes. And if there is -- if there are recommendations that conflict, maybe get a manager or ms. Dinkler, with those two members of the court, I知 trying to comply with the law, here, john. Hopefully come up with a draft that's acceptable to all of us and incorporate recommendations and go ahead and get them out to the managers. I think the draft was real good. The major thing I think was instead of sending them to the court we send them to ms. Dinkler with a deadline. The other things were minor.
>> my things were kind of wordsmith things. I think we all want simplicity, clarity, what is the ask of us and where do you send it to.
>> is that okay? So if you get your -- get your recommendations to me, what I値l do is try to get them in one document, get with ms. Dinkler, then we'll get them out.

>> mine are too. I would not communicate with court members unless we need to. And our goal would be if you get that to us tomorrow at noon, my goal will be to get it to the officials either tomorrow afternoon or Thursday. Okay? That's the motion.
