Executive Session Items
Now, in my view we need to take up the reimers and hogge discussion up in executive session. That is number 18, which is to consider and take appropriate action on the following. A is agreement with milton reimers and wife for purchase of land in southwest Travis County. 18-b, agreement with hogge canyon springs limited, et al, for purchase of land in southwest Travis County. C is reimbursement resolution for the purchase -- don't need that in executive session, I don't think. Let's call it anyway, just in case we need advice of counsel. Reimbursement resolution for the purchase of land in southwest Travis County. And 18-d is authorization for certain persons to sign closing related documents for purchases of land. These will be discussed in executive session under the consultation with attorney and real estate exceptions to the open meetings act. 36 is to receive briefing from county attorney and take appropriate action regarding entertainment by j and j inc. Versus rufino cornejo and luke mercer, constable, precinct 1, consultation with attorney. 37, consider and take appropriate action regarding lease/purchase agreement for the jp constable precinct 2 offices at 10409 burnet road. That's the real property exception. Let's also announce consultation with attorney on 37. 38, consider and take appropriate action for the potential purchase of real estate in central Austin. That's the real property exception. Let's also announce sexual assaulttation with attorney. 39, receive legal briefing and take appropriate action on tax rebate agreement with samsung Austin semiconductor llc, consultation with attorney. 40, receive legal briefing and take appropriate action on tax abatement agreement with home depot u.s.a., inc. Consultation with attorney. 41, receive briefing from county attorney and take appropriate action regarding permit amendment application on waste management of Texas for Austin community recycling and disposal facility, tceq permit number msw-239-d. Consultation with attorney. 42, receive briefing from the county attorney in Travis County et al versus floyd cecil renfro, nicklaus peter, incorporated resale deed, and take appropriate action. Consultation with attorney. 43, receive briefing from the county attorney in Travis County et al versus jack fox, ned holmes junior resale deed. Consultation with attorney. 44, receive briefing from the county attorney in Travis County et al versus byron b. And cora b. Miller, vincent g. Murdock resale deed and take appropriate action. Consultation with attorney. And a-1, we may need to discuss with legal counsel in executive session. In case we do, we'll announce it now. A-1 is to consider and take appropriate action on request to amend Travis County economic development program policy, and that will be under the consultation with attorney exception to the open meetings act. We will discuss these items, but will return to open court before taking any action.
We have returned from executive session where we discussed the following items: 18-a involving the proposed agreement with the reimers family for the purchase of land in southwest Travis County. Go ahead, Commissioner.

>> we'll be negotiating who pays for that fence around the 80 acres. I was going to suggest authorize the judge to sign it and finalize those negotiations.

>> any discussion? All in favor? That passes by unanimous vote. 18-b involves a proposed agreement with the hole canyon springs ltd and others, and there's a contract there with a condition in it. As far as we know it's in good shape also, right?

On 18-c I move that we approve the proposed reimbursement resolution for the purchase of these two tracts of land, and that is basically the county general fund loaning money to pay for this. And when we issue the co's and get funding for that, we reimburse the general fund.

>> the closing is next Tuesday. Now, going to the items that were posted for executive session. It may be a good idea to go to a-1 because that affects two of the others. We did have a proposed amendment to the Travis County economic development program policy. Move that we approve the proposed amendment; however, we did make one change, and that is we do not give ourselves the ability to waive the language regarding building over the aquifer, and that is section 28.004-a-12, so that gives us flexibility under certain circumstances to waive the provisions under the policy, but not that one. Any discussion of that? All in favor? That passes by unanimous vote: 39 is a proposed agreement with the samsung Austin semiconductor llc. We did have a lengthy discussion of several provisions that impact home depot and samsung. Move that I be authorized to share that information with the -- with jerry converse of samsung with whom I’ve been chatting over the last few weeks, there by freeing up mayor yet ta to work on one of the other agreements that she's been working on.

>> yes, ma'am. We'll have that one on, plus the next one. The next one is the proposed settlement agreement with proposed tax abatement agreement with home depot. We did give staff a lot of recommendations. We should say as a matter of record that the Commissioners court is still having difficulty reaching agreement with home depot on language that would enable us to verify the number of employees and the capital investment.

>> capitalization is the only thing left to be worked on. And there were other more minor provisions that we will share with home depot and discuss between now and next Tuesday. Have this matter back on the agenda and hopefully it will be ready for approval. That's I guess in the form of a motion?

Number 36 is a matter involving j and j incorporated versus kornejo and luke mercer, no action required today and the county attorney will put this back on the court's agenda when it's ready for us to take action. 37 involves the jp constable precinct 2 offices on burnet road.
>> judge, I move that facilities and all other appropriate staff, including the county attorney's office, be authorized to enter into negotiations for the purchase of this building using the direction in terms of strategy that was talked about in executive session.

>> discussion? All in favor that passes by unanimous vote. 38 involves the potential purchase of real estate in central Austin. We did discuss this matter under the real estate exception. Any action required today? We will keep the landlord posted on developments and the staff will discuss with him provisions of a potential contract between the two of us, and there are other matters that need to be worked on and we discussed that those matters will probably take staff about two weeks. So we'll have this back on the court's agenda on December 6th, two weeks from today.
>> judge, did we also say that we would authorize the sharing of a draft contract with the owner of this property, knowing that it is subject to changes by the Commissioners court because we are in a parallel path of making sure that that draft contract has every single t and dot that we want in it.
>> that's fine with me. I think I mentioned terms and conditions, didn't i? If not, that's fine. Staff is working on those and doing other due diligence. We'll have this back on 12-6. And on 37, did we say that would be back on next week or 12-6? 38, 12-6.

>> okay. We'll have 37 back on December 6th, '05 also. Number 47 involves we've got an update regarding the waste management of Texas -- 41, with tceq. No action required today, right? We appreciate the update. Number 42 is one of several resale deeds that we were presented, and in number 42, I move that we authorize the county judge to sign the proposed tax resale deed to nicklaus peter, nompted who has paid Travis County $12,000 in cash. Discussion in all in favor? That passes by unanimous vote. On number 43 I move that we authorize the county judge to sign the proposed naks he sale deed to ned holmes, who has paid Travis County seven thousand dollars in cash.

>> discussion? All in favor that passes by unanimous vote. On number 44, I move that we authorize the county judge to sign the first of three proposed tax resale deeds to vincent g. Murdock who has paid Travis County the sum of $2,726.62, and this is for lot number 22.

Number 47, I move that we authorize the county judge to sign the tax resale deed to green rs investments llc, which has paid Travis County $24,417.28 in cash.
