Executive Session
Why don't we take executive session. 38, receive legal briefing on county options in cases where property owners have constructed encroachments in county right-of-way without the permission or knowledge of Travis County, and take appropriate action. Consultation with attorney. 39, receive briefing from county attorney and take appropriate action in entertainment by j & j, inc. V. Rufino cornejo and luke mercer, constable, precinct one, et al. (requested by county attorney) consultation with attorney exception to the open meetings act. 40, receive briefing from county attorney and take appropriate action regarding entertainment by j & j inc. V. Celia perez, veronica perez govea and luke mercer, constable, precinct one, et al. Consultation with attorney. 41, consider and take appropriate action regarding lease/purchase agreement for the jp/constable pct. 2 offices at 10409 burnet road. That's the real property exception to the open meetings act. 42, consider and take appropriate action on office space lease proposals for counseling and education services. That's the real property exception to the open meetings act. 43, approve or reject proposed farmers market lease agreement with russell haertl d/b/a sun tint, inc. Consultation with attorney and real property exception to the open meetings act. 44, consider and take appropriate action on an offer to buy an exclusive access, cable and equipment easement submitted by southwestern bell telephone, l.p. For land owned by Travis County along fm 973 in precinct four. Consultation with attorney. And real property exception to the open meetings act. 45, consider and take appropriate action on temporary assistant to the chief operating officer in medical examiner's office. That's the personnel matters exception to the open meetings act. 46, receive briefing from county attorney and take appropriate action regarding permit amendment application of waste management of Texas for Austin community recycling and disposal facility, tceq permit no. Msw-249d. That's the consultation with attorney exception to the open meetings act. And the tamara armstrong item, which is number 29, approval sole source exemption and contract with easy access for tax bill mailout and related processing services. Consultation with attorney exception to the open meetings act. We will discuss these matters in executive session but will return to open court before taking any action.

I move that we approve the proposed contract along with the indication that this is a contract that serves the public, and -- what else did we need to say? It includes the exemption.

>> work its way down the road on this one, we've worked with the vendor and I guess we've been able to reach agreement more often than not. Discussion? All in favor? That passes by unanimous vote. Number 38 we did not discuss. We'll have it back on the court's agenda next week before a brief discussion. 39 and 40 we had brief discussions on those. They'll be put back on the court's agenda after a November eighth hearing in dallas, Texas. It will be put back on at about the same time. 41, after a very brief discussion, we concluded we need another week on that one. 41 will be back on the court's agenda next week, October 25th. 42 will be back on the court's agenda next week also let me just announce at this time we did not discuss in executive session item 22. It was not announced. We will not get with this item today because it probably will lead to a lengthy discussion. We will post that item next week at a time certain, namely 9:30 a.m. And it will have a different number, but we'll discuss what's on as 22 this week, along with item number 42. Those two are interrelated, so a disposition of one impacts the other, so we'll make sure we discuss both next week.

Let's reject their offer, but indicate our intention to negotiate a more acceptable settlement agreement with them with conditions regarding their future use of this land and responsibility to relocate utilities if there is a state highway expansion project.

>> so staff will get with them. They need two weeks. We'll have it back on the court's agenda November 2nd. Is it the first or second? All right. November 1st, '05. 45 we discussed briefly. We'll need this one back on next week.

>> we didn't vote on 44. It wasn't unanimously approved.
>> no, it is now.
>> was there a second to it? All in favor? That passes by an enthusiastic unanimous vote.

>> 45 we discussed briefly. We'll have it back on next week for further discussion and hopefully action. 46 is the expansion application filed by waste management of Texas.
>> judge, move that we bring back that particular item when it's deemed necessary and direct county staff to proceed in the direction that we've discussed and we'll have this back on when the time is appropriate.
>> okay. We do remind staff that the court is formally record in opposition to a waste management expansion in its Travis County location.
>> right. Make sure it is of public record that we are in opposition.
>> this will be on the agenda at capcog as early as tomorrow morning and in the future. So until further notice, county staff should indicate that the previously indicated position.
>> exactly. Thank you.
>> so we don't need any action on that one, do we? We have given staff those directions. Any objection to those? Okay. Then as melissa looks around at us, that is all of you are business today.
