Item no. 1 is a public hearing to receive comments regarding the filing of an instrument to vacate a portion of a five-foot public utility easement lying on the south side of lot 3, block cc, located block cc located in aqua monte section 2, a resubdivsion of lots 1, 3, 4 and 5 of block e; and lots 5 - 9, 13, and 14 of block d - a subdivision in precinct 3.

>> good morning, joe gieselman with transportation and natural resources department. The owner of this house asked that we vacate a portion of this 5-foot utility easement because of the encroachment of the existing house, a corner of the house, within the easement. They are trying to sell the house. Of course this clouds the title. We have contacted the utility companies, they do not have any problem with the vacation of this portion. So we would recommend the vacation.
