Executive Session Items
That brings us to executive session. 28 we talked about previously, the charge for vehicle uses for non-county services by peace officers, we will get legal advice from jim connally under the consultation with attorney exception to the open meetings act. Number 35 we have been asked to pull, we will not discuss 35. We have been asked to pull that. That will be put back on when we need it. 36. Receive legal advice and take appropriate action on county policy and legal jo standards regarding speech activities on Travis County property and facilities. That's the consultation with attorney exception to the open meetings act. 37. Receive briefing from county attorney and take appropriate action in entertainment by j & j, inc. V. Rufino cornejo and luke mercer, constable, precinct 1. That's the consultation with attorney exception to the open meetings act, also. And we will discuss a 2, receive briefing from county attorney on lease at 2501 south congress and take appropriate action. Consultation with attorney and the real property exception to open meetings act. We will discuss this matters in executive session.
>> item no. 3 on the budget.
>> we also need to discuss 3 on the budget this morning we had a public hearing on the tax increase and budget. And we also in executive session had a brief discussion of some of the new public notice requirements for tax increases, that are set forth in senate bill 18, so we will have a further discussion with counsel of the new requirements in executive session on under the consultation with attorney exception to the open meetings act. We will discuss these items but will return to open court before taking any action.
We have returned from executive session where we discussed the following items. Number 3 involving the proposed '06 tax increase and budget. We did get legal advice. No action required in today's meeting in my view. Anybody else have any? We also discussed the charge for use of county vehicles for non-county business, 28, number 28, and got legal advice. In my view no action required today. We'll have that back on next week with a slightly different wording on that to cover all of the impact to peace officers. 35 was pulled. 37 we announced, but did not success. That was pulled also. We discussed number 36. Let's take another week and try to refine it and then post it for a public meeting, okay? And let's try to review, close review what ms. Aldridge has prepared for us and provide any input to her. And on a-2, which involves the lease property at 2501 south congress, I move that we approve the requested extension of the due diligence period through September 30th of '05.
>> second.
>> discussion?
>> first amendment to the lease.
>> beg your pardon?
>> it's priewmd that this includes the first amendment to the lease. There's an actually document we have to sign.
>> which includes the first amendment to the lease. Discussion? All in favor? That passes by unanimous vote.
>> judge, we're not going to do anything on item number 9? That's not needed, it's not necessary?
>> no. I was notified that no action required on nine, so we'll just pull that, have it back on when we need it. I had it on the agenda sort of running week to week in case we needed it. We have taken several actions and etcetera just a matter of getting those done now and working with mr. Hobby who has come back to assist us.
>> I’m sorry to be back today, but I wanted to get y'all's guidance on item 15-a. Remember this was the cedar street vacation item. We had a part a and a part b that originated last week. It came back today.
>> somebody needs to move to reconsider 15-a so y'all can take that back up, if that's what you want to do.
>> is that what you ask, that we reconsider the action taken?
>> yes, sir.
>> I’m not going to.
>> okay.
>> why don't you send us an e-mail after today indicating if there's been some development.
>> make it awe numb.
>> maybe some development that we don't know about that we should know.
>> okay. Certainly.
>> we know this has been an agonizing experience for several of us, including you. [ laughter ]
>> certainly. Okay. Thank you very much.
>> move adjourn.
>> second.
>> all in favor? That passes by unanimous vote.
