Number 30. Receive and consider petition for the creation of Travis County emergency services district no. 13 in northeast Travis County. I have historically put this item on the agenda and the tax assessor, basically pursuant to her certification. Has examined the petition. And basically found it to be appropriate. 100 registered voters signature on the petition. She submitted a lot more than that. The voter registrar, nelda wells spears certified 107 so they had certified 7 more than she needs. This is on here for us to receive it. The [indiscernible] because what we also have to do real soon is schedule a public hearing and the public hearing and date. That we are looking at -- well, actually, I guess next week.

>> we will set the public hearing, but the date we're looking at setting the public hearing for is November 15th, 2005. And immediately after next week, what will happen --
>> [indiscernible] the election.
>> actually, was setting the public hearing for November 15th, 2005. We are hoping that the election will be in the fall. Because the law requires after that public hearing, dan, you may want to sit there, after that public hearing, that the residents have to petition elgin. To provide certain services. And elgin has to be given -- how many, six months.
>> six months, yes.
>> six months to comply with the request. If elgin does not, then residents that live in the e.t.j. Can then petition elgin for the right to participate in a vote on the --
>> creation.
>> creation of the district.
>> yeah. So but today I just laid that out, we communicated the legal provision, chapter 775.011, emergency services districts. But today it's really just to receive it and next week we will have an item on the agenda for us to conduct a public hearing.
>> okay, that would be fine.
>> how many residents live in the e.t.j.? Do you know offhand?
>> we are not sure. We can't determine that number based on the way that we had our voter registration set up. We know how many people live in the city of elgin that's in Travis County.
>> okay.
>> the portion of elgin that's in Travis County. That's 52, I believe.
>> but are they still working with the elgin officials trying to resolve whatever differences there are?
>> right, once this petition is filed today, that gives them the signal to go ahead and ask elgin for permission consent to include the e.t.j. In the new district. Elgin has 60 days to -- to give that response. That's why we want to have the public hearing about 70 days out so we will know where elgin is coming from.
>> when we say that this is looking like it might go to a fall election, is there any thought that this might be able to be combined with our November 8th election that we are already tossing, that that would be the best way that they could get it on --
>> that's fine for the committee. If elgin gives consent within the next 60 days, then we would go for the may election.
>> got it. Because there are getting into some deadlines related to the justice department. Yada, yada.
>> city election deal wouldn't it?
>> that's right. But the clerk will be conducting -- [multiple voices] yeah.
>> so what's here today really is to formally receive the petition, which the voter registrar has certified as signed by 107 registered voters, seven more than a minimum, and we will thin file this with the -- then file this with the county clerk. Next Tuesday we will set a public hearing on November 15th of 2005.
>> yes, sir. That would be correct. Let me correct you, sir, it's 105.
>> okay, yeah, 105, in election precinct 107.
>> yes, sir.
>> move that we receive the petition.

>> well, it amaze his -- amazes me how it cat the legal requirements -- intricate the legal is.
>> volente bypassed didn't want to be esd number 13, so we actually did skip 13 intentionally. There are 13 esd's right now, but they didn't want to be 13. I’m making sure that they knew that they weren't forced to be esd 13. They could be 15.
