Item no. 18. Consider and take appropriate action on the Texas moratorium network to use the county parking lot on 10 -- at tennessee lavaca for -- at 1010 lavaca for a rally on Saturday, October 29th, 2005. The time requested is from 4:00 to 6:00. In the afternoon,.

>> my name is scott cobb, with Texas [indiscernible] network. We have been holding a rally in March in downtown since 2000 every year. This year we would like to use the Travis County property at 1010 lavaca because -- mostly because we are going to be starting at the hyatt regency this year, a lot of people are kind of older, they don't want to walk as far as we did last year, which was on the other side of the capital to the Texas court of criminal appeals. It will be a lot better for them to make it shorter and went to this parking lot.
>> this is the rally for a moratorium against the imposition of the death penalty.
>> that's correct, yes, sir.
>> where do you normally wind up at in terms of -- are you normally on public property? I guess is really where I’m headed with my question.
>> yes. Normally we are on state property. The last two years we have been at the plaza in front of the court of criminal appeals shared by the supreme court. This year for -- like I said, we would like to move a little bit closer to where we start.
>> in terms of when you go on to state property, do you have to send a note or tell somebody ahead of time how we are going to wind up on public property.
>> right. We deal with -- with the state buildings and procurement office for the -- for that space and then the state preservation board handles the other areas of the capitol like the south steps, we are not dealing with them this year. We are dealing with the buildings and procurement office if we were to go back to the court of criminal appeals.
>> this is outside where you place signs, give speeches?
>> yes, yes.
>> try to keep it orderly.
>> yes, sir.
>> judge, I was the one that asked to take this off and over lunch I got a little more mellow and decided as opposed to getting political about this thing, it was just a matter of people parking I mean no use making --
>> most of our people won't be parking because they are going to be going down the street walking, Marching.
>> is this something that we generally --
>> we don't have to have a license --
>> my question was why didn't you go ahead and do it. My guess is it wouldn't be a big deal.
>> because we have people coming from out of town, we didn't want to get will there and have police officers come and say you don't have permission.
>> [indiscernible] license agreement so [inaudible - no mic] plus [inaudible - no mic] we are waiving responsibility for that.
>> do you recommend we get a license agreement in this case?
>> [inaudible - no mic] if she hasn't already done it.
>> is that what you had in mind.
>> yes.
>> we have done that with the box festival to use the garage, just to make sure in case anybody trips and falls that had he had permission to be here to begin with, makes it easier.
>> okay.
>> [inaudible - no mic] insurance department.
>> I don't really know anything about that.
>> let's chat with them, see what our normal requirements are. Try to facilitate it. This is outside rather than inside, I know if you are inside as an organized rally when the property otherwise would be closed it raises issues that an external property would not, seems to me. My thing was I mean if there are people around there, gathered on county property --
>> I know that state never requires us to provide any insurance. We use both -- we have dealt with both of the state entities.
>> are you the point person?
>> yes.
>> well, then we authorize the rally, we ask staff to chat with scott, try to facilitate the rally as much as possible.
>> second.
>> especially as long as it stays outside on Saturday.
>> right.
>> should we give you a few minutes leeway, 2:00 to 6:00.
>> that would be fine, too. 2:00 to 6:00. We are probably going to start at March at 3:30, get there by 4:00, leave by 6:00. If you want to go a little earlier, that would be great, just in case.
>> 3:00 to 6:00 then in case --
>> sounds good.
>> 3:00 to 6:00.
>> in case some don't want to March but go there and just wait on you.
>> yeah, that's true.
>> discussion? Any more directions of staff necessary? All in favor? That passes by unanimous vote. Now Commissioner Daugherty is not that mellow. He knows enough to support it not to come.
