Executive Session Items

We indicated our intention to call up 10-e, the proposed bond covenants, in executive session for advice of counsel. And the other executive session items are 35, consider purchase order received for property at 6701 burnet road and take appropriate action on options for sale. That's the consultation with attorney and the real property exception to the open meetings act. We do not need 36 as it is the same as 37. We have been told. 37 is to consider and take appropriate action on the potential purchase of real estate on airport boulevard. Real property exception to the open meetings act. 38, receive briefing from county attorney and take appropriate action on final settlement of disputed charges for utility services with the city of Austin. Consultation with attorney. 39d, receive briefing from county attorney regarding proposed mediation in Travis County versus cotera, kolar and negrete.

>> 39 we will not take up in executive session. That will be back on the court's agenda next week. That's 39. 40 is to consider and take appropriate action on purchase contract with diane finch grant for the acquisition of approximately 83.404 acres of land in connection with the balcones canyonlands conservation plan. 41, receive briefing from county attorney and take appropriate action regarding the application of magna-flow, per miltie number wq 04484-000, tceq docket 2005-0199-slk. Consultation with attorney. 42, approve or reject farmers market lease with les femmes and take appropriate action. Real estate exception to the open meetings act. 43, receive legal advice and take appropriate action on issues relating to the Travis County economic development program policy and/or tax abatement policy. Consultation with attorney. 44, consider and take appropriate action on an agreement for financial incentives for home depot. Consultation with attorney. 45, k-rp and take appropriate action on application by samsung for a financial incentive agreement. Consultation with attorney. 46, consider and take appropriate action on acquisition of land for the development of Travis County southwest metropolitan park project. Cip number 01-b02-31-3pa. Consultation with attorney and real estate exception to the open meetings act. And number 47 is consider and take appropriate action on a three on month extension of lease at 4920 ih-35 location for the period of September 2005 through November 2005. Consultation with attorney. And real estate exceptions to the open meetings act. And we have two added items. For executive sex. Ecutive session. Entertainment by j and just a moment versus rafino and mercer constable precinct 1. This will be the consultation with attorney exception. And a-2 will be to receive briefing from county attorney and take appropriate action concerning extension of leave for pay for counseling and education service employees slot 27. That's the consultation with attorney exception and the personnel matters exception to the open meetings act. We will discuss these matters in executive session but will return to court before taking any action.


we have returned from session -- we have returned from executive session where we discussed the following announced items. 10-e involving the proposed bond covenants for the bonds pursuant to the recommendations of the citizens advise I have bond committee. Did get legal advice. Any action required on this item?

>> I think we can do it next week. We may want to have staff on standby in case we have additional questions.

>> okay. 35 involves the potential sale of property at 670 # 1 burnet road. Any direction on that one?
>> yeah, judge. I would indicate that we are favorly inclined to have discussions on this particular item related to going with a broker agreement, and so it would include a request to purchasing to please expedite the rfqs related to getting a pool of brokers so that indeed we might be able to take advantage of that technique, in particular -- in relation to this particular property and others.
>> discussion? All in favor? That passes by unanimous vote. On number 38 involving what used to be a dispute regarding utility -- charges for utility services by the city of Austin, Austin energy, I move that we authorize the county judge to sign on behalf of the Commissioners court a full and final mutual settlement and release which contains the agreement that Travis County owes the city of Austin $17,870.22, but that the city of Austin owes us $13,754.78, which means that the difference there is a net that we owe the city of Austin, and it is about $4,000. That in addition to basically executing this, we send a nice letter to them thanking them for their fine was social securities and -- services and expressing their glee in having this matter resolved.

>> I was caught in the middle of the announcement and did not discuss that. 40, the potential purchase of land for the bccp from diane finch grant, and Commissioner Daugherty?
>> yeah, judge, I would move that we extend the offer through September the 13th, 2005 at the same price. This would include access through the settlement property along with access that would be vacated when the city access off of pearce road comes through and we have been told that the mayor is going to wrk with us on that.

>> Commissioner Sonleitner seconds first. Discussion? All in favor? That passes unanimously. 41, involves the application of magna flow international incorporated and the mediation that we have gone through. I think tom has already indicated to the mediator that we have not been able to settle this matter and it should be left on the active document -- docket. Okay. Any additional action required by us today? It will be put back on when we need it. Okay. 42 involves a farmers market lease agreement with les femmes krause culiniares.
>> I would move approval of the lease.
>> discussion? That takes us through may of 2008. All in favor? That passes by unanimous vote. 43 involves our follow-up discussion of the draft Travis County economic development program policy and/or tax abatement policy. We are making progress on that. Let's give it a final look-see between now and about Thursday or Friday, and get those changes to mayor et ta. We did discuss that in 44 what we hope to do is take the draft proposed agreement involving home depot, incorporate whatever changes we have in 43 and we direct her to send it to the attorneys for home depot, who have been anxiously awaiting delivery of the document and then when they get back with her on whatever changes they have, it will be put back on the court's agenda.
>> judge, is the intention on 43 that we ought to be able to take final action on that policy next Tuesday?
>> yes, ma'am. Due or die Thursday or Friday of this week and next Tuesday when we see the document with the changes incorporated we'll be able to take action and any disagreement we can discuss those and act one way or the other. Okay? But on home depot, probably ought to hold off on that a couple of weeks -- let's put it back on anyway in case something comes up that we need to discuss. Number 45, move that we indicate to the public that in exchange for the 700 permanent manufacturing jobs at an average salary of $60,000, plus the 200 permanent contract jobs and the capital investment of about $3.5 billion, Travis County is willing to consider an 80% abatement on incremental taxes on real property and an 80% abatement on new equipment for a period of 20 years. And that we further direct staff to plug these figures and any other appropriate language into a draft agreement with samsung for the court's consideration and action next week. And our intention would be to approve the draft. We'll send the draft document to samsung representations for -- representatives for consideration and appropriate action.
>> judge, could we maybe suggest staff to see exactly what the 20% of tax is left over?
>> they told me once before, but I can't recall what it was.
>> what will be actually taxed.
>> I will get pbo to share that number with the court hopefully early tomorrow morning.

>> any discussion? All in favor? That passes by unanimous vote. Number 46, the possible acquisition of land. We did get an update.

>> we'll have it on in subsequent weeks.
>> all right. We'll leave it off. 47 involves a three month extension request to the lease at 4920 ih-35. Move that we approve the lease extension of three months through November 30th of 2005.

>> and whatever document there is for the court to execute on behalf of the Travis County Commissioners court, the county judge will be authorized to go ahead and do it. All in favor? That passes by unanimous vote. A-1 we did get a list from the county attorney's office, and I move that we do the following as to this litigation, that is, entertainment by j. D. Incorporated versus precinct 1 constable number 1, move that we reject the settlement in the amount of $243,175. Two, that we authorize the county attorney's office to file notice of appeal as necessary. Three, that we authorize the county attorney to file a micus brief and all relevant appellate cases and proceedings. Four, that we authorize the county attorney and appropriate staff to forward information regarding this matter to all appropriate state and local officials, and that we have this matter back on the court's agenda in the case -- in the event that we need it next Tuesday.
