Now, we did announce earlier, mr. Nuckols was smart enough to leave the courtroom, that we would take up item 3 in executive session under the legal consultation exception to the open meetings act. 3 is the matter involving the memorandum of understanding with browning-ferris industries. And posted for executive session are number 25, receive briefing from county attorney and request expert witness and authorize county attorney to accept, reject or counter settlement demand in michelle faught versus Travis County. Consultation with attorney. Receive and briefing from county attorney in sing koe j. Dba johnson oil company versus Travis County, consultation with attorney. 27, consider and take appropriate action on purchase contract with diane finch grant for the acquisition of approximately 83.404 acres of land in connection with the balcones canyonlands conservation plan. That's the real property stoepgs the open meetings act. 28, receive briefing from county attorney and take appropriate action regarding the matter of the application of magna-flow international, incorporated, permit number wq 04484-000, tceq docket number 2005-0199-slg. Consultation with attorney. 29, receive briefing from county attorney and take appropriate action in rows even bomb versus Travis County. Consultation with attorney. 30, receive legal advice and take appropriate action on issues relating to the Travis County economic development program policy and/or tax abatement policy. Consultation with attorney. 31, we don't need today, that's the home depot item. We need to keep carrying it because the minute we think we have one under 30 we will take it. And 32 -- we won't take 31. 32, receive briefing from county attorney to accept, reject or counter settlement demand and/or take appropriate action regarding angela d. Stedtler versus Travis County. 33, receive briefing from county attorney and take appropriate action regarding Travis County precinct 2 constable office employee slot 7. That's the consultation with attorney and personnel exceptions to the open meetings act. 34, receive briefing from county attorney and take appropriate action regarding request to provide employee benefits to employees of hospital district. Consultation with attorney exception to the open meetings act. We will discuss these in executive session but will return to open court before taking any action.


Good evening, we have returned from executive session where we discussed the following items, number 3, we did have legal questions answered, no action required in my view, that matter will be back on the court's agenda at the appropriate time in the court's agenda two or three or four weeks from now depending on the circumstances. We also discussed number 25 michelle faught versus Travis County. I move that we reject and renew the offer two or three weeks ago.

>> we will have that back on next week. But we -- we are going to -- the motion would be for a one-week extension of the contract, bring it back next week.

>> judge, I would move that we move towards settlement for this where we would be paying mr. Rosenbaum $170,000, also as part of that agreement we would be getting, you know, legal documents saying that we also are getting a drainage easement along with that offer.
>> okay. We authorize the county judge to sign on behalf of the Commissioners court as the draft agreement -- as the prepared agreement.

>> any discussion? All in favor? That passes by unanimous vote. We did discuss 30. The Travis County economic development program policy and/or tax abatement policy. Move that we proceed with the draft as outlined by the county attorney. And that we take the draft policy and I guess put it in final shape for adoption next week, as well as apply it to the home depot item, number 31, which we did not discuss today. That motion is on 30. Seconded by Commissioner Gomez. Discussion? All in favor? That passes by unanimous vote. We did not announce or discuss 31. 32, involving angela steadtler versus Travis County, move that we reject the offer pending completion of discovery.

>> discussion? All in favor? That passes by unanimous vote. Number 33 is a matter involving the precinct 2 constable office employee slot 7. There is an outstanding issue of the $20,000 that we paid to settle this case. Move that we take $4,200 in salary savings from the precinct 2 constable office budget, and that we provide the necessary supplemental amount, $15,800 from the Travis County risk management fund.

>> discussion? All in favor? That passes by unanimous vote. And number 34 involves the possibility of the county providing employee benefits to the employees of the hospital district. Move that we request that the three employees keep working as they have been doing to secure coverage elsewhere. That we take no action today and that they report back to us at the appropriate time in the future when they have exhausted other options and I guess need us as a last resort.

>> judge, as a friendly, and to keep us appraised of when cobra deadlines, pop up on each of the three people who are impacted by this --

>> all right. We did discuss 28. Tom will touch base with the neighbors in that matter and we will have it back on the agenda next week and hopefully by then we will know exactly how to proceed.
