Number 37 is to receive briefing from county attorney and take appropriate action regarding the matter of the application of magna flow international, incorporated, permit number wq 04484-000, tceq docket number 2005-01 nine-slg under the that's the consultation with attorney exception to the open meetings act. 38, receive briefing from county attorney and take appropriate action in rosenbaum versus Travis County, that's the consultation with attorney exception to the open meetings act. Number 39 I think we need to wait on that, don't we? That's the economic incentives tax abatement issue. Barbara? I think mayor retta is still working on that one as well as 40. They're tied together. I need to pull my committee together this week and see if we can get something. I’ll announce it anyway just in case. 39 we may take up and that is that's the consultation with attorney exception to the open meetings act, receive legal advice and take appropriate action on issues relating to the Travis County economic development program policy and/or tax abatement policy. 40, I know we won't take. That's the home depot. Because 40 depends on the action that we take on 39. 41, consider and take appropriate action for the potential purchase on request for the potential purchase of real estate in central Austin. That's the real estate exception to the open meetings act. Let's also post that one under the consultation with attorney in case we need it. 42, receive briefing from county attorney and take appropriate action regarding Travis County precinct 2 con strabl office employee, slot number 7. That's the personnel matters and consultation with attorney exceptions to the open meetings act. We will discuss these matters in executive. I did announce that item anyway just in case. We'll come back and do nothing. And we will do nothing in executive session but discuss the items that we announced. We won't take until action until we come back to open court.


we have returned from executive session where we discussed the following items. 36 we did not discuss we announced. 37 did we discuss any action necessary today? Should we have that back on next week in case there's a report back? Let's do that on 37. 38, we discussed and Commissioner Daugherty?
>> judge, I would direct -- I would move that we direct the county attorney to communicate with mr. Rosenbaum's attorney regarding the agreement of June 3rd, 2004 and he get back with us.

That passes by unanimous vote. 39 we did not discuss. We'll have it back on next week and try to get the committee, the internal committee to meet on that and have something to work on. Did not announce or discuss number 40. 41, no action today. We'll just do due diligence over the next couple, three weeks and if we need it back on the agenda we'll put it back on. 42 involving slot 7 in the precinct 2 constable office. Our counter to settle was accepted. Move that we ratify the one additional date of leave with pay that the county judge authorized pursuant to this court's authorization last week.
