Executive Session Items

Now, we have several executive session items. Let me go in reverse order. A 1 to consider and take appropriate action on security issues at the hope building, posted under the security exception. A 2 is to receive legal advice and take appropriate action on issues relating to the Travis County economic development policy. That's posted under consultation with attorney. 39. Receive briefing from county attorney and take appropriate action regarding michael galbert v. Officer castillo, et al, that's consultation with attorney. 40. Consider and take appropriate action on counter-offer received from les femmes culinaires on settlement and release for gas line repairs at farmers market. Consultation with attorney. 41. Receive briefing and take appropriate action regarding ongoing litigation in congressional redistricting matter. Consultation with attorney. 42. Receive briefing from county attorney and take appropriate action in rosenbaum v. Travis County consultation with attorney. 43. Consider and take appropriate action on personnel issues regarding the acting emergency services coordinator. That's -- that's the personnel matters exception to the open meetings act. We will not have number 44. That matter has been postponed because it has been resolved. It will be put back on the court if it is needed at any time in the future. We will discuss these matters in executive session, but will return to open court before taking any action.


we returned from session where we discussed the following items. Number 30 involving michael galbert versus officer cass tealio and Travis County. No action is required today. We got an update. The county attorney will keep us apprised of developments. 39. Number 40 -- i've been doing that all day, haven't i?

>> judge, their counteroffer, they need to mark down some time specific language and scope, but in general we're amenable what they're talking about, but the county attorney will offer some very specific language when it comes back. Time specific -- how do I say this? Time specific in scope.
>> second. Discussion? All in favor? That passes by unanimous vote. 41 involves the ongoing litigation and congressional redistricting matter. Move that we authorize our outside lawyer in this case to proceed with the appeal. Discussion?

>> right, to the u.s. Supreme court, which means filing of -- well, appealing it, filing a petition, etcetera. What lawyers are paid to do, right, john? Discussion? All in favor? Show Commissioners Gomez, Davis, Sonleitner, yours truly voting in favor. Abstaining or voting against?

>> Commissioner Daugherty voting against.
>> and number 22 would actually extend the contract.
>> item 22.
>> move approval.

>> and 22 is to approve the extension of the contract number for litigation services. He's the outside counsel who has been representing us in this matter. Funding is already available for the next few months. This is for the contract that's about to expire. Any discussion? All in favor? Show Commissioners Sonleitner, Davis, yours truly voting in favor. Voting against, Commissioner Daugherty. Number 42 involves the action by mr. Rosenbaum against Travis County. We have staff directions to send an appropriate letter to mr. Rosenbaum and do we need to have this on the agenda next week in the event that there is need for follow-up action? We post this next week.

>> discussion? All in favor? That passes by unanimous vote. 43 we did have that discussion with the acting emergency services coordinator. In my view no action necessary at this time. Any -- is that agreeable? Okay. We did not discuss number 44, as that matter has been resolved. If it is needed in the future, though, that will be put back on the court's agenda. A-1 is the matter involving security issues at the holt building.

>> seconded by Commissioner Gomez. Discussion? All in favor? That passes by unanimous vote. A 2 is involving the Travis County economic policy. Move that we direct our assistant county attorney working on this matter to make the appropriate changes to our current policy that we gave directions on, and that specifically we indicated that the maximum financial incentive that we approve would be 80%, and that would be one of the criteria that we do not waive under any circumstance. And hopefully the revised policy will tell you that.

>> specifically that's July 12th, right? That's when we'll have a full compliment of board members here. Discussion? All in favor? That passes by unanimous vote.
>> [inaudible - no mic]. It was already budgeted. I just wanted clarification if it's coming from security reserve, I would need to either post it for next week or do an automatic.
>> I think I said directed line item. This says -- what item number was that?
>> a-1.
>> move that we reconsider a-1. All in favor? That passes by unanimous favor. You did hand me a note, and the note says also direct pbo to do an automatic transfer in the amount of $22,362..95 from the security reserve.

>> it would be 22,363 in whole dollars.
>> 363 instead of 362.95. Better get your question addressed.

>> any discussion? You were second, right? Judge Biscoe will if nobody else is bold enough to do it. All in favor? That passes by unanimous vote. Let's give the clerk the exact amount in the note that was slipped to me.
