Now at 1:30 we did ask if anybody were here on the item involving ball fields, number 28. Anybody here on 28? 28. Consider and take appropriate action on a request for fee waiver from the Round Rock intruders for a softball tournament at southeast metropolitan park on June 25 and 26, 2005. That's this coming weekend. The gentleman that made request, have you seen him?
>> I have not seen him here.
>> judge, I think one of the reasons this came to us, these ought to come to the Commissioners court since we set the fees. But I can tell you that we get these requests all the time at northeast metro. It pains me to say, the reason that that fee is set is because is the fee that's been set and it still doesn't even come close to covering what our costs are and that for folks that are interested in having the more inexpensive fields or even the more expensive field, you can't start a couple of months out. They are very popular and I wish we had more room for everybody, I wish we had less costs, but I’m not comfortable setting a precedent here that I can tell ya we'll have 14 of them coming from northeast metro within a week if we do. And folks just need to be -- I appreciate the fact that you tried to find them other fields or see what else could be worked out. But we don't have much time, you can't really help.

>> I don't know him. I just kind of communicated with him in an e-mail.
>> I talked to him on the phone.
>> I asked him to get with staff to discuss the issues, see if they could be worked out. If they couldn't work them out to bring it back to the court because it is a court policy and the court needs to listen to the fact. And then decide whether to issue the waiver or not.
>> okay.

>> my recommendation -- your recommendation is no, right.
>> that's correct.
>> my motion is to deny but for staff to always work with anybody to see if other arrangements or other things can be found for them that will work.

>> discussion? That's basically to reject the fee waiver or reduction, we are told basically about the policy, et cetera. All in favor? That passes by unanimous vote. Thank you all very much.
