29, approve payment of claims and authorize county treasurer to invest county funds.
>> good afternoon, judge, Commissioners, frank holder, assistant purchasing agent. The reason we had to not let this item go consent this morning is because there is a check that is among those you are being asked to approve that has some unique situations. We have a contract with c. C. Carlton construction company for the construction of east metro park, and typically a contractor is paid direct, that is, the checks are made out in this case to c. C. Carlton. But shortly after the contract is signed, he is out getting his pavement and performance bonds and he found somebody who would cover him, but a condition is that the checks would be made out to a second party. That changed in January when he went out and got brand new payment performance bonds. They did not require him to have that condition and therefore it allowed the checks to be paid direct to c. C. Carlton. We are in the process of getting the contract modification to the court next week. But we are asking the court to go ahead and approve that check today because I forgot the exact amount but it's in the area of 300,000 to $400,000 and we hate to hold that up for a week.
>> and that's invoice number 4. Based on my e-mail from roger. So he's done the services, we relied on the old notice, I guess, now we can send the checks directly to him; there's no reason not to.

>> move approval of claims and investment and with the change that frank has laid out related to a direct payment.
>> that will get it for the auditor? That's all we need?

>> no, no, we need to [inaudible].
>> no problem. Seconded by Commissioner Davis. All in favor? That passes by unanimous vote. Thank you all very much.
