Executive Session Items
We were asked to roll for one week number 29, so that will be back on next Tuesday June 7th. And number 37, john says we are still waiting on two of these lessees to submit claims.
>> you mean 36?
>> I mean 36. Right. So my recommendation is that we give them a do or die date of two weeks from today. And if we do not have their claims then, we will assume they do not have claims or are not bold enough to submit them.
>> this is 14?
>> 14. Two weeks. Next week is the landfill meeting unless something else happens. I see one of the claimants here.
>> you may want to -- I think he wants to address that issue that we just -- that you and I discussed earlier.
>> is it one of the missing ones?
>> no, he's the one who has already presented his and I think he's a little frustrated that we're waiting on the missing ones.
>> well, we have to.
>> you ma be even more frustrated because my recommendation we give the others a drop dead date of two weeks from today. And if they haven't submitted them by then, we just assume their claims either went away or they chose not to submit them.
>> I went ahead and asked them about them.

>> tim thomas from Travis County farmers market. I discussed that with mr. Hilly and he mentioned that the two weeks, which is fine by me. But I think everybody else is just kind of -- they are not really making any progress, you know, trying to get any bids or anything like that and I think it's because they are kind of comfortable where they are at right now. Whereas myself, I知 very much not comfortable where I知 at and I知 just trying to make progress. We're trying to go live on our public opening at the restaurant June 8th. And after that I really won't have a life to do anything but work there and that's why I wanted to kind of address this before -- hopefully I wanted to try and address it before we opened the restaurant up.
>> well, part of our direction is for john to write one of his fiery memos giving the June 14th deadline. And on that day we will proceed with whatever we have.
>> okay. And then also for any additions, for example since the last time that I put in my -- I guess when I submitted the costs or whatever, that's been at least a month now, I知 guessing. I mean I can't even tell anymore in time. But since that time of course i've paid more rent and more maintenance fees and I wasn't sure if I was supposed to edit that page or --.
>> it's whatever you desire. It's your claim.
>> okay. So I wanted to know if it was okay to submit anything else. I wasn't sure.
>> it's not a settled claim yet.
>> okay.
>> be guided by that June 14th deadline. Sooner the better, right, john?
>> are you in business?

>> we're trying to open still. And it's been -- three weeks -- three months and two weeks now. And it's killing me.
>> so you could find yourself after the 14th with no resolution from us and then you really are upside down with --

This is posted under the consultation with attorney and the security matters exceptions to the open meetings act. 29 we'll have a next week. 30 is to receive briefing from county attorney and take appropriate action in kyle and sandra kincaid versus county of travis and rgm contractors, and john, maybe I should back up and take 28 in just a minute. Number 28, right? Or was it another one?

>> yeah, but we're going to discuss that in executive session. I mean discuss security kinds of things in executive session and can have an appropriate discussion outside. Otherwise people will say the wrong thing. We don't intend to --
>> if I announce number 30 is under consultation with the attorney open meetings act. 31, receive briefing from county attorney and take appropriate action on proposed settlement amount regarding sub ro base claim of Travis County in angel hernandez versus done dile. That's the consultation with attorney exception also. 32, receive briefing from county attorney in Travis County versus gregory d. And carol a. Tillitt and take appropriate action. Consultation with attorney exception. 33, receive briefing from county attorney in Travis County et all versus ferris l. And katherine f. Grooms. Marina rundell resale deed and take appropriate action. Consultation with attorney. 34, receive briefing from county attorney in Travis County versus howard buuldin, jr. Jimmy and belinda fultz resale deed. And take appropriate action. Consultation with attorney. 35, receive briefing from county attorney in Travis County et al. Versus lonny d. And janice s. Allison, and take appropriate action. 36 we just announced a reset to June 14th. 37, consider and take appropriate action regarding an opportunity to lease or purchase real estate in south central Austin. That's the real estate matters exception to the open meetings act. And 38, receive legal advice on options to amend or delete section 82..203 a 4, Travis County county code, relating to temporary suspension of preliminary plans outside of e.t.j. Of cities. Consultation with attorney exception. We will discuss these matters in executive session and return to open court prior to taking any action.
we have returned from executive session. Number 28 we did discuss. We need to give staff an opportunity to draft a written description of several measures and discuss that draft with us on June 14, 2005. That's two weeks from today. If they will get copies of that memo to county attorney and you will make sure we get that a couple of days before the 14th so we can review the various options and be ready for a full discussion on June 14th.
>> and that's presuming that there's going to be coordination with planning and budget in terms of any kind of redeployment of resources, et cetera, et cetera.
>> yeah, I知 not sure how much they will get done in two weeks, but at least they ought to try to get all the specific recommendations in writing and prior to order. Hopefully touch base with some of the stakeholders and get some feedback from that and to the extent possible look at funding sources, possible redirection of funds, chatting with p.b.o. Some of this may be capital purchases as well as --
>> that was the other thing, separation of what are one-time capital expenditures versus ongoing.
>> right. 6-14 is when it will be back on. We did not discuss 29. It will on next week June 7th. Number 30 is the matter involving kyle and sandra kincaid. Move that we consent to the proposed settlement agreement and authorize staff to draft -- to work with the parties on an appropriate settlement agreement and release.

>> we need to see that at some point, don't we?
>> they've already drafted -- audible audible.
>> then my motion is consent to the agreement. Second?

>> discussion? There -rl several matters we were told somebody needs to ensure they happen. So I guess the assistant county attorney working on the case for us will make sure that gets done. Number 31 involving the subrogation claim of Travis County in angel hernandez versus done dile. Move that we authorize a reduction of the lane by one-third to cover attorneys fees under the Texas labor code.

>> discussion? All in favor? That passes by unanimous vote. Number 32, move that we authorize the county judge to sign on behalf of the Travis County Commissioners court the prepared resale deed to ariel verrey who has paid Travis County the sum of $2,592.37 in cash.

>> discussion? All in favor? That passes by unanimous vote. Number 3, I move that we authorize the county judge to sign the prepared resale deed to marina rundell, who has paid Travis County the sum of $2,955.83.

>> discussion? All in favor? That passes by unanimous vote. Number 34, I move that we authorize the county judge to sign the prepared resale deed to jimmy and belinda fultz, f-u-l-t-z, who have paid Travis County the sum of $4,563.93.

And in item number 35, I move that we authorize the county judge to sign another resale deed to marina rundell, and this involves the property of lonny d. And janice s. Alice son. Because ms. Rundell has paid Travis County the sum of $3,488.52.

Number 36, we previously announced we would have that back on in two weeks to give the claimants a chance to file a reupb claim. 37 we did discuss. We need that back to agenda and authorize county staff and consultant to keep negotiating an appropriate contract in that matter.
