Executive Session Items

Now, that brings us to executive session, right?
>> I can take one more off the list for you. The tenants item, the repairs claim number 32, I’m still waiting for the information from one of the tenants. I have not received it, I have informed the other two tenants that have made claims that that's what we are waiting on. So there's nothing to report on that for today.

>> we do not need 32 or 29. 30. Receive briefing from county attorney and take appropriate action in michael galbert v. Officer castillo, et al. That's the consultation with attorney exception to the open meetings act. 31. Receive briefing from county attorney regarding status of management agreement of the farmers market with rylander investment co., and take appropriate action. That's the consultation with attorney exception to the open meetings act. 33. Consider and take appropriate action regarding an opportunity to lease or purchase real estate in south central Texas. That's the real property exception to the open meetings act. That's -- let's also announce consultation with attorney on 33 just in case we need it. A 1 is to receive briefing from county attorney and take appropriate action concerning an additional extension of administrative leave for an employee in Travis County, precinct 2 constable's office, lot 7. That's the consultation with attorney and personnel matters exceptions to the open meetings act. We will discuss these items in executive session but will return to open court before taking any action.


we have returned from executive session where we discussed the following items, number 24 regarding a request by duke bishoff, certain information from the farmer's market.
>> judge in connection with this item, I would move that a second letter be written to mr. Rylander seeking the following information in relation to the equipment that at one point belonged to mr. Bishoff and his wife. We would like to -- we want an accounting of the sale of that equipment. We want an accounting of the rent collected since January 1, 2004 in relation to the property that at one point was rented by the bishoffs. We want the documents related to the sale of equipment by hill rylander. The county is requesting all documents relating to the notice of sale of the equipment by hill rylander. The county is requesting all applications for a distress warrant. We want the bill of sale to danny wright. We want the list of equipment sold to mr. Wright and we want the application of proceeds from the sale of the equipment and any advertisements of sale related to the equipment that at one point belonged to the bishoffs and then an appropriate letter be drafted by the county attorney and send letter under his signature requesting immediate.
>> and indicating under what authorization.
>> for the second time the specific portion of the management contract that says that he is to be maintaining these records on our behalf.
>> seconded by Commissioner Gomez. Any discussion? All in favor? That passes by unanimous vote. A related item, number 31, involving the status to have management agreement of the farmer's market are rylander investment company. Question get legal advice on various aspects to have contract, any action required today?
>> we just have this matter put back on when necessary.
>> ... Deposit a check they've received from rylander investments?
>> I believe that we have discussed the -- that we have the necessary protections in place in the event this is sufficient. So...
>> and I can further follow-up with a letter back to him saying that the Commissioner's court has received this check and is expecting the final accounting with balance.
>> this check turned over in a timely manner in accordance to what was in the contract with this check on time?
>> no, it wasn't.
>> it was not on time. I would like for that to be a part of the record, please.
>> move approval of john's request. We deposit it, send an appropriate notice with an indication that it admitted. Discussion? All in favor. That passes by unanimous vote. Number 30 involving the case of micheal galbert against officer castillo, I move that we authorize the county attorney to indicate to the plaintiff in this case our willingness to pay him the amount of $1,050 notwithstanding invoices that total to an amount that would leave slightly more -- slightly less than that and authorize the county attorney to have executed the appropriate settlement agreement. Discussion?
>> if for any reason that the amount would be due back to the sheriff's office for paying all the bills is in excess of 3950, which is the differential between the settlement and the $5,000 which was the total settlement amount, that is an amount that gets eaten by the sheriff's department.
>> right. You understand if we do the 1050, the difference would be 3950, so that's what the sheriff has coming, period.
>> period. Capped.
>> any amount over that the sheriff has to pay for.
>> correct. Thank you, judge.
>> okay. All in favor. That passes by unanimous vote. 33, we did get another briefing on, I move that we authorize staff to continue lease negotiations and on preferred option.
>> ... That was one that we did not have a problem with not pursuing.
>> okay. That's fine.
>> they know which one that was.
>> anymore discussion? All in favor? That passes by unanimous vote.
>> [inaudible]
>> yeah, we've been -- I think on that last item we were kind of running out of time on it, we may as well make sure we have it posted weekly for the next two or three so in the event we need it we'll have it. Anything else today Commissioners? A 1.
>> oh. A 1 is the request for additional extension of administrative leave for an employee in Travis County precinct two. Authorize payment for the additional 12 days which should carry the employee through may 31, 2005, and indicate our strong desire to have this matter concluded by that time.
>> county holiday on the 30th, so it really takes us through may 31.
>> okay. Anymore discussion? All in favor? That passes by unanimous vote. All in favor. That passes unanimously too.
