Number 2 is a public hearing to receive comments regarding request to authorize the filing of an estimate to vacate a 7.5-foot public utility easement lying on the north side of lot 271, block o located in imperial valley section two - a subdivision in precinct 1.
>> yeah, move that the public hearing be opened.

>> all in favor? That passes unanimously.
>> as the -- the owner of this parcel asked for the vacation of the 7.5-foot public utility easement. The utility companies have been notified. None have need for the easement. We would therefore recommend its vacation.
>> would anyone like to give testimony during this public hearing? That's item no. 2?
>> I have one thing, judge, if anyone comes up. Okay. Joe, any particular requests for this public utility easement request, there may be a possibility in the future of a retaining wall erected there, I just want to make sure that the applicant that -- that is applying for this vacation realizes that there are still procedures that must go through the permitting and all of those other things must go through as far as trying to get a retaining wall. Because, number one, this is in a high floodplain area. And, of course, we do have a lot of flooding issues there. I just want to make sure that the applicant understands that this is just one step in the procedure and that that's no guarantee that they will be permitted, receive a permit from the county to allow this particular retaining wall.
>> you are absolutely correct, Commissioner. The applicant would need to have a permit from Travis County to erect that retaining wall.
>> okay. I know maybe -- as far as the first step, but he must have a permit. Okay. Thank you. Move that the opinion hearing be closed.
>> all in favor? That passes by unanimous vote. This will be action item no. 13 on today's agenda.
