Executive Session Items

That brings us to executive session. Item number 32 is receive briefing from county attorney regarding claim against harley davidson, incorporated, and take appropriate action. Consultation with attorney exception to the open meetings act. 33, consider and take appropriate action regarding the opportunity to lease or purchase real property in south central Austin. Real property exception to the open meetings act. 34, receive briefing from county attorney and take appropriate action regarding compliance by Texas disposal systems landfill, incorporated with the terms of the license agreement with the solid waste transfer station facilities for the solid waste transfer station facilities at 4001 state highway 620. That's the consultation with attorney and real property exception to the open meetings act. And number 35 is to discuss and take appropriate action on contract with republic of Texas biker rally for 2005 event. Consultation with attorney exception to the open meetings act. We will discuss these items in executive session, but will return to open court before taking any action.


we have returned from executive session. Where we discussed the following items, number 32 involving a claim against the harley davidson, move that we authorize the county attorney's office to retain the services of a mechanic and authorize expenditure of up to $200 to get these services performed. Any discussion? All in favor? That passes by unanimous vote. 33, involves the opportunity to acquire or lease real property in south central Austin. We did give staff directions and we'll have this back on the fourth next week. Any further action necessary today?
>> just making sure that the county attorney's office knows that their assistance is necessary [indiscernible] so that we can come into court next week that much further ahead if that's the way we're going.
>> okay. 35 involving the republic of Texas biker rally for the 2005 event. We discussed with the county attorney certain provisions in the contract and request that the county attorney contact representatives for the republic of Texas biker rally with an eye toward having a final document for us to sign next Tuesday, so we'll have it back on the agenda and if the county attorney and facilities and expo representatives have questions or initials to discuss anything with the court between now and then, there is a subcommittee of Commissioner Davis and myself that can provide some guidance, but -- but we will have it back on next Tuesday for action. Otherwise, I don't think any action is necessary today.
>> it's our hope that they will have a signed contract to be presented to the court so that our action is the final action and we all can move along on that.

>> 34, involves Texas disposal systems transfer station on county owned property at 40 -- 4001 state highway 620. Let me try a motion. I move that we ask the county attorney to prepare an appropriate letter to forward to the appropriate representatives for Texas disposal systems and in that letter we request payment of the sum due for 2000 in the amount of $37,698.12 and that we request for '04 and '05 the amounts due for the previous years, '03 and '04, the same amount paid in '03 that we indicate to mr. Gregory the county's agreement to toll the running of the time set forth in the demand letter until may 15th, to give us an opportunity to pursue two or three options in addition to the one mentioned in that demand letter, which basically was litigation.

>> do we need to give certainty on the date of when that check -- or expect -- our expectations of when that check shall be turned over to Travis County.
>> that's actually to be done by Friday of this week.
>> judge, also, I would like to make sure that the options may be still -- still held open for the appraisal whether it's going to be lease or sold or whatever, but I would like to make sure that the omses are still -- that the options are still available as far as appraisal is concerned. I don't want to close the door on that.
>> buying ourselves some time.
>> right.
>> that's why I mentioned two or three options.
>> yeah.
>> hopefully -- hopefully by two to four weeks we will have an opportunity for specifics under each option. A little more details than what we have available at this time.
