3 is a public hearing to receive comments regarding the partial cancellation of a recorded subdivision: travis settlement, section one as recorded in book 84, pages 24c-26b in precinct three, vacation of: a. Lots 1-4 and the rights of way (row) of sean avery path, north derrick cove and south derrick cove; b. Lots 5-31 and 45-54 and the row of sean avery path, north derrick cove and south derrick cove; and c. Lots 32-44 and 98-99 and the row of sean avery path, north derrick cove and south derrick cove (partial plat vacation - 56 lots and approximately 4961 feet row - 109.966 acres - bee creek road - no fiscal required - no sewage service provision involved in vacation - no municipal jurisdiction).

>> hi, carol joseph, t.n.r. And ana bowlin with t.n.r. This looks complicated but it's fairly simple. There are three owners that wish to replat their the entire section of travis settlement section in that they are going to -- in that they are going to, I guess in item 9 or 8 later on, they are going to make one lot in one section, phase 2 will then go through replatting and what we have is a preliminary for that. And phase 3 is going through all of the fiscal and in phase 3 they are also going to -- it a private use driveway and it's going to be widened and have a turn around within phase 3. So -- so it's a combination of three, just looks complicated but it really isn't.
>> I would like to clarify that not all of section 1 is part of this -- this agenda request. There's some parts of the original section 1 that aren't affected but they did get certified mail for this. I did receive a call asking for clarification from one person in that and I called and met with them and once they understood what was going on, they did not have any problems with the proposed action.

>> would they pipeline because on this particular one there is no municipal e.t.j., kind of out this that zone, they are not going into an administrative -- issue here.
>> they have been working on the revised prelim for several years. They were complete proo irto this. In -- prior to this. I think they would have had for us to even get the signs up in time.
