Executive Session Items

I think we're ready for executive session. This morning we she had we would take up the liability claim for ms. Fisher and item number 20 on the consultation with attorney, so we will do that. 34 is to receive legal advice on personal injury accident at Travis County farmer's market and take appropriate action. That's that's the consultation with attorney exception to the open meetings act to the open meetings act. 35, consider and take appropriate action on offer to sell needed right-of-way for the cedar valley/fits hugh road bridge number 313 replacement project, cip number 01 b 01-20-3 ba located in precinct 3. That's the real property and that's the consultation with attorney exception to the open meetings act. 36, receive briefing from county attorney and take appropriate action regarding compliance by Texas disposal systems landfill incorporated with the terms of the license agreement for the solid waste transfer station facilities at 4001 state highway 620. And number 39 is to receive briefing from county attorney and take appropriate action regarding compliance by jbdi incorporated and metro 620 utilities limited with agreements executed as condition of approval of plats for forest bluff subdivision. We'll discuss these matters in executive session, but will return to open court before taking any action.


we have returned from executive session where we discussed the following items: do we -- did you hand those to us? As a kind of follow-up to this morning's discussion of number 6 --

>> now, we did discuss the following items in Commissioners court and we discussed number 20, which is the property liability claim of mary rose fisher. This is one of those cases where the claim clashes with the law, but in the spirit of compromise I recommend that we offer to pay the fishers one half of the cost to repair damage done to their car as a result of the incident made the basis of this claim. In my view that would be one half of $570 or whatever the exact amount is, we agree to pay 50% of that if mr. Fisher will agree to compromise the claim in that manner. And would you communicate that to him, mr. Mansour and we'll have this on the court's agenda -- well, if that's agreeable, we'll just prepare an appropriate settlement and get it done that way. And if not, then we'll have it on again next week for a denial, I guess.

>> any more discussion? This is in the spirit of compromise and trying to resolve this satisfactorily for both of us. All in favor? That passes by unanimous vote. We also discussed number 34, but we will need answers to specific questions that we had, so no action is required on 34 today and will be back on the court's agenda next week. That's on March eighth of '05. And item number 35 involves right-of-way for cedar valley fits hugh road bridge project, 313.
>> judge, I would move that we instruct our tnr folks -- I don't know whether that would be to offer $3,500 to mr. Fleming for the right-of-way purchase for the cedar valley fitzhugh road replacement.
>> discussion? That passes by unanimous vote. Number 36 involves Travis County owned property that is now leased to Texas disposal systems, and move that we prepare an appropriate default letter to send to the owner of Texas disposals systems, but at the same time we make known our position that we should continue to try to resolve differences in this matter by the contract default letter has to give a 30-day notice of default before further action is taken. So hopefully during the next 30 day period we will continue to work and resolve this manner.
>> judge, if you don't mind, I don't know whether it would be considered an amendment to that or aattachment to that, that we also instruct mr. Greg chico to meet with tds and to go ahead and see if we can't resolve the payment for the 1999 year where the issue was the $20,053.28 for the septic session.
>> you're seconding the motion?
>> yes.
>> and judge, i'd like to also get with tnr staff to go out and visit that site. And also I probably need to talk with mr. Gregory on this because we had some conflicting deals on this. And i'd like to know a little more about it. So at this time I just want to make sure that I do that before -- during the process. I want to make sure that that does take place, that I have a chance to get into a little more than -- I'm just not comfortable at this time.

>> discussion? Also that this job description be shared with the managers who are affected by the new duties and responsibilities. All in favor? That passes by unanimous vote. On item number 38, move that we approve the job description, the new job description that we were given covering the coordinator of county emergency services, which basically changes his duties and responsibilities, and that these be shared with the affected department heads.

>> discussion? All in favor? That passes by unanimous vote. 39 we'll need back on the agenda next week. Anything today? Yes.
>> that's a good suggestion. Thank you very much. Let's indicate that. Any objection to that being incorporated into the motion? Then it will be done without objection. Anything today on 39? We'll have it back on the court's agenda next week for action. And that does it for today.
