Number 44 is to receive briefing and take appropriate action in paul koen versus margo frasier, et al, that's the consultation with attorney exception to the open meetings act. 45, consider and take appropriate action regarding termination of brokerage services agreement between Travis County and buls hodge consulting. Consultation with attorney. 46, consider and take appropriate action on acquisition of land for the development of Travis County southwest metropolitan park project, cip number 01-b02-31- 3pa, consultation with attorney and real property exceptions to the open meetings act. 47, receive briefing from county attorney regarding settlement negotiations on claim received from keystone construction, incorporated for work at northeast metropolitan park and take appropriate action. Consultation with attorney. 48, consider and take appropriate action regarding the relocation of counseling and education services from lease space at 4920 north ih-35. Real property. Exception to the open meetings act. And 49, receive briefing and take appropriate action regarding settlement offer in jody marshal versus Travis County, et al, consultation with attorney exception to the open meetings act. We will discuss these matters in executive session, but will return to open court before taking any action.


we have returned from executive session, number 44 involving paul koen versus margo frasier et al, I move that we authorize the county judge to prepare the settlement documents. As soon as they're ready for settlement in this matter for the amount of $15,000.

On the grounds that we have not appropriated money to purchase the real property in question, move that we terminate this agreement and authorize the purchasing agent to sign on behalf of the Commissioner's court.

>> 46, judge, we are-- I move that we tip our due diligence in moving forward with talking with certain parties and looking into seeing what we're going to do with the the southwest metropolitan park project. We'll bring that back, say, probably within two or three weeks and update the court.

>> number 47 involving the settlement negotiation on the claim of keystone construction, inc. Versus Travis County for the work done at northeast metropolitan park.
>> we hope you never hear about this again motion which is really going to be a change in process as opposed to how we did it before, I would move we approve the settlement for key stroan construction for work at northeast metropolitan park in the amount of $218,008.60 for the release of all claims and this constitutes the resolution of all final change orders.

Number 48, which involves relocation of counseling and education services from lease space at 4920 north ih-35, move that we authorize county staff to act on the relocation of cbs which means basically trying to find suitable alternative space in the appropriate price range at another location at describe by the ces managers. Anything else we need to do? At the end of the contract at this property in the contract expires in August of '05. That will get done for us, won't it?

Item number 49 involving jodi marshall versus Travis County county et al, looks like we have settled this matter for $75,000, move that we authorize county judge to sign the appropriate settlement papers and that we authorize county staff to keep negotiating with the attorney for jodi marshal on some recommendations that we have for Travis County, try to figure out an appropriate way to try to get those to the appropriate manager, manager or officials at Travis County. Discussion? All in favor. That passes by unanimous vote.
>> judge, we need to bring back up eye them number 42. Mr. Hilly has some clarification language that we need restate it a different way so we can make sure we've got all of our bases covered. May I move that we bring back up item number 42 on nootsie?

>> I received word over the lunch hour that there was as privilege usually explained to you, you had one set of easements that you're releasing on a document that was prepared and is in the backup today, that Travis County which found out owns all the property around the track that we're about to buy, so we're able to -- the land owners of nootsie has asked us to release two crisscrossing easements, it's found out there was an unplated easement, no one knows where it is but it's on the paperwork somewhere, but should have been added to the release that y'all were asked to consider earlier today, so what the attorney did for nootsie was to prepare a second easement so you're actually needing to approve two easements. A release of two easements. If you're to close tomorrow, I need both of those documents to be able to do that. If you have the least doubt about an open meetings issue, put one of the items -- i'll put the second one on to ratify that release of easement for next week, if you have any concerns there. But I need both documents if I’m to be able to close tomorrow.
