We happen to have a 2 minute item, number 42. Consider and take appropriate action on request for release of easement to facilitate closing of the purchase of bccp land from nootsie ltd and I want to know the reason for the release makes sense for the county. I've heard it before and the answer is real simple.

>> he says it's a one minute explanation. This is a property we are trying to close on perhaps as early as tomorrow using our authorized section 6 grants, I’m trying to tap dance until he walks in the door but I know we're going through title commitment as we speak and there were left over easements on there, so for us to have clear title to the nootsie property which is located off 620, tap, tap, tap, we need to get these easements cleared off of there for us to have clear title.
>> this is an easement that we don't need in the future.
>> that's correct.
>> we need to close on the land more than anything else.
>> yes, sir.
>> and are we acquiring this land or condemning it?
>> we're acquiring it.
>> acquiring it, currently it has an easement on it in favor of Travis County that gives us access to an adjoining tract and so you're releasing an easement on land you're about to buy.
>> whether that makes sense or not it makes sense we ought to do it.
>> when we buy the land the easement would go away anyway, but it's better if there' a release document in the record. So at the end of this that is what we're getting out of. Something to file in the record that shows that the easement no longer exists on our own land.
>> I thought it was a little different from what I recall but I couldn't remember exactly what it is.
>> make sure no one else sees an easement and say I want to tailgate advantage of that.
>> I’m happy.
>> I move approval.
>> second.
