22. Consider and take appropriate action on the following: a. Contract award
for excess workers' compensation insurance, rfp no. P040131oj, to the qualified
respondent, frost insurance agency; and b. A sixty-day coverage binder, through
December 31, 2004. Move approval of b.

On a I did have a problem because I could not understand why we were choosing
frost over the other one. I looked at the matrix. And had a hard time just
interpreting it. Can you just walk me through it? I’m pretty sure --
>> the matrix was actually done, the evaluations form were
actually done prior to the best and final offer of the top two. Midwest employers
casualty through frost insurance agency and then mcgive seabold's proposal
were next to next. We asked for bfo's on both. When they come back the midwest
employers casualty came out better mainly because of the lower premium on
an annual basis and the extra added quality of mcgriff sea bold's of the general
liability policy didn't -- since it was in excess didn't really provide us
any additional coverage to warranty the extra premium that we would have to
pay on an annual basis.
>> okay. [indiscernible] company is really the broker for
six other insurance companies?
>> well, yeah. Kind of like an alphabet house. They represent
numerous insurance companies. They send them -- our requests out for bid and
then act as the contractor for those.
>> all right. When I looked at the -- at the sheet, I saw
255 for mcgriff seabolds and friends or company, then I looked across the
board and I was looking for the low number or high number?
>> high number.
>> 256.5.
>> so 255 looked real good compared to everything except
midwest employees casualty.
>> one of their quote, yes.
>> so now do we -- how do we guarantee that we don't end
up with one lower than mcgriff?
>> well -- I don't think that I’m -- mcgriff seabold's under
the evaluation came up next and next with the best proposal from midwest employers
casualty under the frost insurance company.
>> let me ask you something.
>> okay.
>> are you telling me that I should throw out all of these
except mcgriff and midwest.
>> yes, sir.
>> that makes sense because midwest has a higher point total
than mcgriff does, right? My question, though, is if frost submitted a quote
for all six of these, we guarantee that the product we end up with and the
premium we pay is based on the midwest employees quote.
>> yes, sir.
>> they are the underwriters.
>> I understand.
>> had an underwriter not any of the other companies.
>> we would be getting a 60 day binder from midwest employers
casualty and then the 60 day would allow us to get the contract in place with
frost insurance as the contractor itself?
>> so our contract would be with midwest?
>> with the brokerage company.
>> which is frost.
>> our contract with frost insurance company was the backup
says, but the company actually providing the insurance would be midwest.
>> correct.
>> somewhere in the contract of whatever we get it will say
that?
>> yes.
>> that way if we get premiums from one of the other companies
we will know something is amiss because it ought to come from midwest.
>> right.
>> okay.
>> which is why I move approval.

>> with frost.
>> I eagerly look forward to receipt of the document we are
supposed to sign. Okay? Any more discussion? All in favor? That passes by
unanimous vote.

>> judge, related to that, we are having to wait until barbara
wilson to get back to actually this -- this is who it's going to. There will
be a final losing of stuff, will that have coco back to the Commissioners
court.
>> I believe purchasing will send it back.
>> in that case we get to see all of the stuff that the judge
asked about. This is the binder saying this is the gig.
>> you are asking to approve to soip to it frost, get a 06
day binder in order to get a contract to you.
>> in place. Sounds good.
>> somewhere in the binder would be midwest, the name.
>> yes, sir.
