2. Receive comments regarding an order of rejection of dedication of public streets and accept the second amendment to declarations of covenants, conditions and restrictions for the ravine phase 1, a subdivision in precinct 3.

>> this is a subdivision where the dedication has been proposed, but has not yet been accepted by the Commissioners court. The residents of the subdivision on -- would like to have a gated community. What they are now asking us to do is to not accept the dedication of the public street, so that it would remain a private street and they would pick up the maintenance of that street. So that's why this is a rejection of the dedication basically turning it back into a private street and then they will -- they will amend their covenants accordingly. So they will pick up the maintenance and be responsible for the gate and the access to that. Our only concern was that the -- as in all of the cases here, that the emergency providers be briefed on this and that they are okay with the gated community. They have been and they are okay with the -- with the rejection of dedication and making this into a -- into a gated community.
>> so who asked us to accept --
>> it comes typically with the -- with the subdivision platting. In the platting of a -- of a subdivision, there's a normal -- normally an offer to dedicate right-of-way to the public for the purpose of accessing streets. The court then accepts that dedication and it becomes a public street. In this case we are mid-way through that action.
>> so our regulations initiated the filing of the application to accept the streets?
>> that's typically, that is the subdivision process; that's correct.
>> would anyone like to give testimony during the public hearing.
>> move to close the public hearing.

>> all in favor? That passes by unanimous vote. This will be action item no. 20 on today's agenda.
