Executive Session Items
Well, I guess we may as well move to executive session and come back at 2:30, we'll take up the housing item. We need to announce the executive session number 60, consider and take appropriate action on selection of executive manager of health and human services and shret ran services. That will be under the personnel matters exception, as we plan to talk about the specific qualifications, skills, et cetera, short comings, et cetera, of the 5 or 6 individuals that we interview and calling them by name. 61 is to receive briefing from county attorney and take appropriate action concerning the extension of leave for a juvenile probation department employee, slot 17, personnel matters exception also. 62, consider offers to sell and take appropriate action regarding drainage easement need bid Travis County for installation of storm water facilities as part of the anderson mill road improvement project cip number 01-b 01-01-3ca, in precinct 3, that is the consultation with attorney and real property exceptions to the open meetings act. 63, consider and take appropriate action regarding the lease between harry whittington, at 205 through 209 west nineth street. That is the real property exception to the open meetings act. We previously postponed item 64 until next Tuesday. 65, I don't think we need. That's hospital district implementation. Anybody know any reason -- we will not announce that and therefore cannot take it up. 66 to receive briefing on security planning for the November election. That is the security exception to the open meetings act. 67 is to receive briefing from county attorney regarding settlement negotiations in richard mccain versus Travis County. That is the consultation with attorney exception to the open meetings act. 68, consider and take appropriate action on request from keystone construction, inc. That is the consultation with attorney exception to the open meetings act also. Item 40, we should take up in executive session too. And that is the approved termination of contract number 03200118 ld with gulf states asphalt or emulsified assault. We'll discuss these matters in executive session but will return to open court before taking any action.
we have returned from executive session where we discussed the following
items. Number 9 involving employee in slot 17 in the juvenile probation department.
Move that we authorize additional leave with pay for nine days beginning September
22nd through October first of 2004.

We did discuss 62 involving anderson mill road. Let's -- we did chat with
staff, they have additional work to do and hopefully bring good news back
to us next Tuesday, this will be back on October 5th, which is next week.
Item no. 63, involves our county lease property at 205 through 209 west 9th
street with -- with harry wittington, dba travis properties. We were asked
to do three things and this one is -- this one is to approve term naiftion
the current lease -- termination of the current lease and to approve a lease
agreement for ces lease space, and that -- that amount of space will be a
short-term lease, which would expire December 31st of '04. The -- the other
will remain unchanged and approve another lease agreement for various departments,
all of this lease space is located at 205 through 209 west 9th street and
so to terminate the current lease, end up with a very short lease and another
master lease, all of which will terminate the end of 2006. And so we are trying
to simplify --

to sign and prepare leases on behalf of the Commissioners court. Discussion?
All in favor? That passes by unanimous vote. Number 64, we did not discuss
today. That will be back on the court's agenda next week. I did not discuss
number 65 involving the Travis County hospital district, that will be back
on next week, also. We did get the briefing on security planning for the November
election in item 66. We will have action items back on the Commissioners court's
agenda for us to take appropriate action next week. Number 67 involves a matter
involving richard mccain, versus Travis County, we'll have this back on the
agenda next week for action. We think we have identified a source of funding,
though, $40,000 in salary savings, in the precinct 4 constable's office. And
-- and an additional 15,250 which will be located immediately from various
and sundry line items in the Travis County budget. Allocated reserve.

>> right. And the Commissioners court will try to figure
out a way to creatively generate $15,250 in '05 to cover this amount.
>> I think, judge, in terms of when we were trying to get
further information, which was the point of this item, about how do we meet
the -- our obligations here, is that we needed to encumber and accrue those
amounts so that when this is brought back to us for final action, with a signed
document from mr. Mccain, that we had already preserved those dollars from
the fiscal year '04 budget so that they could be paid out in '05. That's an
encumbrance and accrual out of constable 4 and whatever p.b.o. Says is the
appropriate line item to let the auditor's office know related to accrual.

we will take action next Tuesday, October 5th. We did discuss number 68 involving
a request from keystone construction, incorporated. After reading the letter
and discussing it with transportation and natural resources, parks staff and
the county attorney's office, it's appropriate for them to draft an appropriate
letter response for the Commissioners court authorizing the county have to
sign that letter and get it to the -- to the person and send the letter to
-- to me as soon as possible, but no later than Friday at noon. We have extended
a deadline for another half day. So they will know the county's perspective
there. We did discuss three options that are available to the contractor/claimant.
