Item number 11 is is consider and take appropriate action on request to adopt order setting the Travis County hospital district tax rate for fy '05. As a result of that work, a tax rate in the amount of .0779 is proposed and I move approval of the setting of a maintenance and operations tax rate of .00779 and there is no debt service tax rate. We don't need to set it as zero, do we?

>> judge, if we may indulge you for one interruption, the hospital district posted their own agenda and their item 2 is to adopt an order setting the same tax rate. This is a belt and suspenders kind of thing. For explanation the statute appears to indicate that the Commissioner's court sets the tax rate for the hospital district and that is what the lawyers believe is the case. But the statute has some unclarity to it, and in order to be absolutely certain that we've done this correctly, the only way we could figure out to do it was to also have the district adopt the same tax rate that did you, so if there's ever any question about it, we've done both and that is their item two and if you could indulge them to take that motion now, they can adopt that same tax rate.
