Executive Session

Now we have come to the executive session items. 32 is consider and take appropriate action on request to determine value of 4.39-acre tract of county land at 4001 state highway 620 for purposes of calculating annual rent for the solid waste transfer station located on the tract. That's the consultation with attorney exception to the open meetings act. 33, receive briefing from county attorney and authorize county attorney to accept, reject or counter settlement offer and take appropriate action in sally decker versus Travis County and steven l. Williams, in his official capacity. Consultation with attorney exception to the open meetings act. 34, consider and take appropriate action on request for investigation into various issues regarding the Travis County medical expecter's office. That's the consultation with attorney exception to the open meetings act. And there's backup on 34. John, I guess you need to wash us on that one, make sure we are doing things that are covered by exceptions to the open meetings act.

Those are posted under the consultation with attorney and the real estate matters exceptions to the open meetings act. 36, consider and take appropriate action concerning acquisition of right-of-way and easements through condemnation proceedings for the cameron road construction project as follows 36-a, parcel number 1 and 1 e, record owner kings gate, lp. 36 b, parcel number 2 and 2 ea and eb, record owner north gate las vegas postponement. And 36 c is parcel number 3 and 3 ea and 3 eb, record owner bishops field, lp. Those are posted under the real estate exception plus the consultation with attorney exception to the open meetings act. 37, receive briefing from county attorney regarding settlement negotiations on claim received from keystone construction for work at northeast metro park and take appropriate action. Consultation with attorney exception to the open meetings act. 38, receive briefing and take appropriate action on ferguson and tuscany way extension project. Consultation with attorney exception to the open meetings act. 39, receive legal advice and take appropriate action on implementation of Travis County hospital district. Consultation with attorney exception to the open meetings act. 40, authorize county attorney to contract with and hire local counsel regarding dessie maria andrews versus county of burnett, et al. To, comply with d.c. Circuit lcvr 83.2 c. That's the consultation with attorney exception to the open meetings act also. We will discuss these matters in executive session, but will return to open court before taking any action.


we have returned from executive session where we discussed the following items. Number -- following items, number 32, more items on the agenda next week. 33 regarding the claim against Travis County, to counter the last settlement offer, offer $55,000 without reinstatement.

On 34 we moved that we would find the document that reviewed with legal counsel, the advice necessary, shared that with the concerned citizens and public as soon as possible. All in favor? Judge, I move that we -- for cameron road, we go ahead with the condemnation proceedings to require right-of-way and also easement for the county road construction project as follows: on parcel number 1 and 1 e, kings gate l.p., B is parcel number 2, and 2 ea. And 2 eb, record owner, north gate, l.p. And number c, parcel number 3, and 3 ea and 3 eb, recorded owner bishop field, l.p., I would like to move approval of that --

>> okay. Discussion? All in favor? That passes by unanimous vote. 37 involves the claim from keystone construction, incorporated, against Travis County for work done at the northeast metro park.
>> and I do have kind of a lengthy motion, melissa we do have a copy for the record. I would move that we reject the claim from keystone construction, incorporated and that we counter with settlement offer of $90,150. This amount will be addressed in the final payment that was to be paid to the contractor. This final payment will also include deducting the force account work by chasco in the amount of 34,450.55 and a county pump claim of $6,180 for a final payment on the contract amount of $161,096.60 to keystone construction inc. And it's subcontractors. Travis County will not charge the accrued liquidated damages of 66,500. The Commissioners court approves the payment of $83,970 from 1997 bond fund savings from the northeast metro park phase 1, line item no. 44049457458120. To meet obligations to keystone and to chasco. Checks should be written according to the settlement documents to be drafted as follows. $15,000 to heritage, 22,246.28 to avery, and 123,952.32 scholars, the balance to keystone, giving us that total of 161096.60 as mentioned.

Item no. 40 involves the matter involving dessie maria andrews versus county of burnet, Travis County and others. Move that we thor the Travis County -- authorize the county attorney to sneacial contract with -- [indiscernible] contract with an attorney in the western d.c. Area and that the amount be set at not to exceed $15,000. That the effective date be August 6th, 2004, [papers shuffling - audio interference] mr. Henderson has already been asked to do work for Travis County.
